- the availability of public roads;

Based on this information, the Criminal Code calculates the costs of cleaning the site.
All information about the territory and its borders is stored in several databases:
- in the State Real Estate Cadastre. All information is reflected on the public cadastral map, which is posted on the official website of Rosreestr. More detailed data can be found in the cadastral passport held by the chairman of the house, administration or the Criminal Code;
- in the Unified Register of Real Estate Rights. The register contains data on the authority to the site, its area, date of registration and the method of establishing boundaries.
Who is responsible for the repair and maintenance of the yard
It depends on whether the site has passed the registration and cadastral registration procedure, who is responsible for the adjacent territory of the apartment building, its maintenance and maintenance.
When forming a land plot of a house built before the adoption of the Housing Code (before March 1, 2005), apartment owners can apply for cadastral registration of land and registration of ownership rights to it to state authorities or local governments.
During the construction of new houses, the land under them immediately becomes the property of interest holders.
It is important to clarify whether a house plot has been formed with elements of infrastructure and improvement. If not, apartment owners have the right to register ownership of it.
When transferring to common shared ownership, the territory on which the MKD is located, the real estate objects and its courtyard must go through the procedure of forming a land plot and be put on cadastral registration.

The powers of the municipal administration
Not always the territory on which the MKD and related infrastructure are located, belong to the residents. Until the corresponding entry in the state cadastre appears and the boundaries of the yard are established, the municipality is considered the owner of the land. It is he who is responsible for the maintenance and repair of the site, regardless of the method of managing the MKD.

The legislative framework
The issues of establishing the ownership right to the local area, and, consequently, the responsibility for its maintenance and repair are regulated by the LC RF (Articles 153, 154, 158) and the Civil Code of the Russian Federation (Article 210).
On the belonging of the site to the common property of the owners and their obligation to finance work related to its improvement, it is said in the Decree of the Government of the Russian Federation of 13.08.2006 No. 491. This document has enacted the Rules for the maintenance of the local area in an apartment building.
The list of works on improvement and repair is established in the rules and standards for the operation of the housing stock, legalized by the resolution of the Gosstroy of the Russian Federation No. 170 of 09/27. 2003.
What works are carried out in the local area
Housing owners in the MKD, who pay monthly maintenance costs for shared property, are usually interested in what is included in the maintenance of the adjoining territory of an apartment building.
According to the law, such works include:
- installation of playgrounds;
- cleaning of parking lots, courtyards;
- gardening of yards;
- installation of waste collection tanks;
- installation of walling around the yard;
- painting elements of improvement;
- repair of MKD territories.
Residents can initiate improvement work by submitting an application to the Criminal Code.
What is included in the cleaning work
The concept of “cleaning the local area” includes seasonal cleaning of snow and leaves, sprinkling pedestrian walkways with anti-slip compounds during ice.
Also, the managing organization must control the timely removal of MSW from the territory.
Maintenance of cleanliness and proper sanitary and hygienic conditions at the entrances and at the sites is the responsibility of the Criminal Code.
Specialized organizations are engaged in the cleaning of intra-quarter roads, and sidewalks and pedestrian paths are first cleaned of debris, and then the roadway.
Garden landscaping
Green spaces play an important role in the design of the courtyard. They give an attractive appearance to the plot and improve the ecological features.
The rules for the technical operation of the housing stock contain the fundamental principles of landscaping:
- work is carried out only after clearing the site from construction waste and other waste;
- it is strictly forbidden to cut down trees growing in the yard without special permission;
- when planting poplar, mulberry, it is not recommended to choose females that cause more active clogging of sites;
- every year a planned treatment of green spaces from pests is organized.
With regard to green spaces, special rules apply, which are obliged to comply with both the employees of the Criminal Code and the residents. A large list of prohibitions is aimed at preventing damage to plants and the preservation of the yard.
Asphalt paving
The poor condition of intra-quarter roads and sidewalks always raises the question of tenants who should repair asphalt in the courtyard of an apartment building. The decision on the need to restore the asphalt pavement must be made by the residents of the MKD at the general meeting.
As a rule, the management company creates a special fund in which apartment owners contribute funds based on the estimated cost of the proposed work.
An additional fundraising for these purposes is connected with the fact that the contractor will choose to repair roads in the courtyards of apartment buildings - an organization selected by the management company.
Repair of roads should be carried out in compliance with the recommendations of SNiP on:
- the minimum permissible thickness of the asphalt layer is 0.15 m;
- the minimum width of asphalt around the house is 1 m;
- the use of fine-grained compositions;
- mandatory coverage of paths leading to porches and car parking.

Installation of the barrier
The decision to install a barrier in the yard is made by the general meeting of the owners of the premises, since tenants have the right to limit the use of the adjacent territory.

Who sets the yard maintenance rates
Tariffing of services for the maintenance of land adjacent to the MKD is carried out by communal organizations that provide them, and in some cases, by local authorities.
The regulatory role in this matter is assigned to the state. It participates in pricing by the adoption of regulatory acts:
- Federal Law “On the Basics of Tariff Regulation of Communal Complex Organizations”;
- individual government decisions.
Market factors have a significant impact on the cost of services: inflation, fuel and lubricants prices, labor remuneration, and others. Tariffs may be revised annually.
Household maintenance fees are charged per square meter, taking into account the share of the tenant in the total property. If the tariff rate is 10 rubles per 1 m2, and the area of \u200b\u200bthe local area is 200 m2, then with a share of 3% the monthly maintenance fee is 60 rubles.
Who to complain about poor service

The minimum list of landscaping works under this project includes the repair of courtyard driveways, the installation of benches and ballot boxes, and the lighting of courtyards. The condition of Russian cities for many years leaves much to be desired. Yards are turning into spontaneous parking, green spaces are being destroyed, and pedestrian infrastructure is declining. But not everything is so bad - for the third year in the country, the implementation of a priority project to create a comfortable urban environment has been ongoing, and residents of almost all apartment buildings can take part in it.
The first serious attempt to turn the tide in terms of the improvement of Russian cities was the development in 2016 of a priority project “Formation of a comfortable urban environment”. The main principle of the project is that the state allocates money at the federal level, and in regions and cities residents decidewhich landscaping objects to send them to.
The project began on November 17, 2016, and it is designed for 5 years - until 2022. To finance the project, 20 billion rubles are allocated from the federal budget for each year, another 7.5 billion will be allocated from regional budgets.
In practice, even large amounts can be mastered - in 2017, 25.6 billion rubles from the federal budget and 16.7 billion from regional budgets were spent on the project.
For 2019, instead of 20 billion, the federal budget will allocate twice as much for the project - 40 billion.
The project is financed in different ratios - for some constituent entities of the Russian Federation, the federal and regional budgets allocate amounts equally, in others - the project is paid in full by “federal” money.
The main features of the project are:
- 2/3 of the amount is allocated for the improvement of domestic territories, and 1/3 of the amount is allocated for other public spaces (parks, squares, recreation areas);
- only residents themselves can decide where to send the money. For this in cities, local authorities must organize a vote for priority landscaping projects;
- the improvement program applies to cities and towns with a population of more than 1000 inhabitants. But it is possible to equip public spaces under the project in the countryside, with certain restrictions;
- there is the possibility of co-financing work by residents for additional elements of improvement that are not included in the project.
The landscaping project is being actively implemented in the country - in 2017 alone, about 19,000 Russian yards were repaired.
What beautification awaits the yard
Due to federal funding within the framework of the program, you can get only a certain “set” of improvement:
- repair (most often asphalting) of internal courtyards and driveways. If the parking is part of the driveway, its arrangement will also be financed;
- repair and arrangement of sidewalks;
- installation of small forms - benches, lamps and ballot boxes;
- repair of entrances (the part that relates to the yard).
These elements of beautification guaranteed at the federal level. In other words, the contractor will not “forget” to pave the courtyard driveway or install and connect lights.
However, yards usually need other elements of improvement. As a rule, residents do not have enough parking spaces, playgrounds and green spaces. These items are funded everywhere in different ways, depending on local laws.
Some regions and cities are asked to pay a certain part of the cost of additional improvement - from 1 to 20%. Money can be taken, for example, from the amounts collected by the management company for current home repairs. For example, in the Sverdlovsk region it is 5%, and in the Chelyabinsk region - only 3%.
Other settlements fully pay for additional elements of improvement. In such a situation, everything needs to be coordinated with local authorities.
It is important that after February 9, 2019, co-financing from the owners cannot be less than 20% of the cost of performing work on additional elements of improvement. This applies only to those projects that will be agreed after this date.
The general procedure for participation in the project for apartment owners is established by local authorities. However, there are still general rules. For example, municipalities give priority to courtyards in the most “deplorable” state - with broken driveways and the absence of other amenities.
When deciding whether or not to include the courtyard in the improvement program for the planning year, local authorities also take into account other criteria - the level of payment of residents for housing services (if they do not pay, then they will not save the object of improvement after repair), as well as the date the house was built - in Russian realities there are frequent cases when there was no repair in the yard at all.
Finally, there is a list of criteria under which the administration will not include the yard at all in the program Improvements for the year:
- among the houses that are adjacent to the courtyard, there are emergency - to be demolished in the coming years;
- similarly - if adjacent to new buildings that are under the guarantee of the developer - as a rule, the warranty period is about 5 years;
- plans for the coming year include repair of communications in the yard - there is no point in laying asphalt if it is destroyed in a few months during the repair of the water supply system;
- for budgetary funds, the yard has already been repaired (either the contractor did his job poorly, or the residents managed to ruin everything again).
Since there are a lot of conditions for participating in the yard improvement program, experts recommend finding out from the local administration whether the yard should be landscaped. Perhaps, for the planning year, all the money under the program has already been distributed to other yards, then you will have to wait for next year.
What needs to be done to improve the yard
Residents of most Russian apartment buildings (with the exception of those listed above) can organize the participation of their yard territory in a project to create a comfortable urban environment.
To do this, go through a number of steps. These stages are governed by the rules of the project, so to “get around” them will not work - to achieve your goal, you need to clearly follow them.
Stage 1 - determine that the yard needs improvement, and is still included in the current program. You can check this on the local administration website. There are frequent cases when other residents of the house have already done all the work, but could not convey this information to everyone.
Lists of courtyards to be repaired this year are posted on the sites of municipal administrations. The section “Formation of a comfortable urban environment” should be opened on the website, there should be information on plans for the current year.
In addition, on the administration’s website you can usually vote for public areas that will be landscaped - parks, squares, streets, etc.
2 stage. If the house is not found in the list for improvement, then you need to create an initiative group residents of the house (and other houses that have a common yard). It is the initiative group that organizes all the work - convenes a meeting of tenants, draws up a work plan, communicates with the administration.
The easiest way to resolve the issue is with the initiative group to residents of the houses in which the HOA is organized, then the chairman, accountant and other participants in the partnership can be included in the group.
Work on including the yard in the improvement plan will require a lot of time, so those who work from morning to night without days off are unlikely to be able to help.
3 stage - development of a landscaping scheme. Although this seems like something complicated, in fact - everything is quite simple. It is necessary to determine what the yard lacks and draw up a diagram.
It’s not necessary to have drawing skills, a diagram can be drawn directly on the map of the yardtaken from the satellite imagery site (Yandex, Google, Bing and other services). In the scheme you need to reflect:
- how the houses are located relative to the yard;
- a place that will be given under the courtyard driveways, sidewalks and parking;
- location of landscaping facilities - lamps, benches, ballot boxes, playground;
- landscaping scheme - where to place trees, lawn, flowers;
- location of other objects.
All you need to pre-measure and indicate the dimensions on the diagram. Specify the need for colors, materials and other parameters. For example, sidewalks can be made of tiles, or can be rolled into asphalt - each option has supporters and opponents.
4th stage - holding a general meeting of residents. It is necessary to collect the inhabitants of the houses to which the house belongs. At the meeting of residents, an improvement plan is agreed upon, the amount of co-financing is approved (if it is assumed by local regulatory acts), the initiative group agrees to collect signatures.
This stage is quite complicated - not all residents will agree with the proposed project, as well as with the fact that landscaping will take place in the yard for several months. Motorists will be against banning parking on the lawn. There is a separate category of residents - who do not agree with any initiatives at all.
To adopt an improvement plan you need to ensure that 2/3 of the residents vote for the participation of the yard in a programme. The decision of the residents is drawn up in the appropriate protocol. The protocol can be compiled using templates that are offered to be downloaded on the site of the local administration. The protocol shall indicate the address of the house, the chairman of the meeting, the improvement plan, co-financing of work, as well as the person responsible for the project.
For those who did not attend the meeting, there is an apartment-by-vote vote for participating in the project. The initiators go around all the apartments and ask to fill out a newsletter (the template should also be on the administration website).
In the newsletter you need to indicate passport data, answer the questions of the meeting and put your signature. Only the owner of the apartment can do this.
5 stage - filing an application with the local administration. The application template should also be on the administration website. All documents available at this time are attached to the application:
- improvement plan (scheme drawn up by the initiative group);
- copy of the minutes of the general meeting of residents;
- ballot papers filled in by the ballot.
Next, the administration of the municipality creates a special commission - it considers applications and selects which yards will be repaired in the planning year. If the city has a small budget for improvement, and there are many applications, then the plan will include the most in need of repair yards, and the rest will be postponed to subsequent years.
If the application is accepted, then the administration will contact the chairman of the initiative group and inform him of the decision.
6 stage - approval of the final design project. Unlike the landscaping scheme, the design project is carried out at a more professional level. It is a detailed landscaping scheme with all the details.
The one who was selected to be responsible for the project will have to coordinate the design project with the administration. You need to make sure that important elements such as benches or a playground do not "disappear" from it.
7 stage - directly carrying out improvement works. Here, the person responsible for the project must control the work of the contractor. Any deviations from the approved project urgent need to inform the administration.
After the work is completed, the representative of the tenants accepts the work performed as part of a group of administration staff. If the work is done with violations, then the act of delivery is not signed until they are corrected.
8th stage - ensure the safety of improvement. Twice, the program will not allocate money for the same yard. Most likely, they will not be allocated for a decade and other programs. Therefore, residents should keep what they received - to prevent cases of vandalism in relation to the yard, sometimes go out on community work days and not throw garbage past the ballot box.
What problems may arise
Problems with the implementation of the project can arise at any stage. So, due to limited funding in some cities and regions, far from all yards fall under the project. Since priority is given to the most needy yards, relatively preserved ones will wait their turn for a long time to come.
The shortage is also a disadvantage, this is due to the bureaucracy: the yard improvement program is approved before April 1 of each year, and the design project is agreed before July 1. The contractor is obliged to complete the landscaping work by the end of the year - and this leaves less than 6 months. Therefore, the peak of work falls at the end of the year, which affects their quality.
Experts have complaints about standard design projects for home improvement. All repairs are reduced, as a rule, to the “pouring” of the majority of the yard with asphalt and the installation of standard benches, lanterns and playgrounds. As a result, the repaired yards are quite similar to each other. Although for many, even such an improvement is a huge step forward.
In most cases, there are complaints about the quality of the work. Builders deviate from the plan without warning - they transfer the locations of some elements, instead of tiles, they fill the sidewalks with asphalt, "Forget" about landscaping. Some contractors also don’t remember the sidewalks.
When coordinating the plan with the residents, it will be difficult to take into account the interests of all - if pensioners need benches and trees, then young parents need playgrounds, and motorists need parking places. Yards are not endless, therefore need to find a compromise solution.

Really good news - the federal program for the improvement of domestic territories comes into effect in the period from 2018 to 2022. This name has an expanded meaning - not only yards, but also squares, parks, squares, embankments will acquire a new look. But the bulk of the money is intended to improve yard areas.
The federal government allocates 20 billion rubles from its budget. The money will be distributed across regions, their administrations will have to think over the correct scheme for the further use of these funds.
The allocated money is intended for the improvement of public places. Permits of ordinary residents to improve the areas and parks are not required, since their rights will not be violated in this case. But the obligations after the improvement of the adjacent territories of the residents will arise. These places will acquire the status of common property. The owners of apartments are required to pay for the maintenance of the courtyards in the proper form.
Distribution by region
There are 85 regions in the Russian Federation. They differ in the size of the territories and in numbers. The largest city in terms of population is considered the city of federal significance Moscow. However, it is one of the smallest regions in terms of occupied area. The opposite situation in Yakutia. Squares, parks and courtyards, apparently, are still more in large settlements. As you can see, the implementation of the program is not an easy task at the first stage.
The adoption of municipal programs
To receive money from the federal budget, regions and municipalities must develop their own program and approve it. The unusual thing is that the inhabitants themselves can influence this. Improvement activities are carried out in the courtyards of apartment buildings only.
The municipal courtyard improvement program, starting in 2018, includes a list of addresses of adjoining sections of apartment buildings in need of improvement. RF Government Decree No. 169 governs that approval must be made no later than December 31, 2017.
What settlements can participate in the program?
Order of the Ministry of Construction of the Russian Federation No. 691-pr approved methodological recommendations, according to which municipal entities with a population of more than 1,000 people are participating in the program.
Who cares about courtyards now?
According to the housing code, the land on which the house is located is common property. But for this a formality must be fulfilled - an official transfer. In fact, most yards did not go through this procedure. Therefore, they are considered municipal property.
Every year, money is allocated to maintain order in them in accordance with their own taste and financial capabilities. A survey of residents is not carried out and, accordingly, their wishes are not taken into account. Residents of the house do not consider themselves owners and do not relate to property with special care.
New rules
In 2022, after the end of the program, new rules will be introduced. Landscaped and pleasing to the eye with grooming courtyards will begin to be considered part of the property. What this means, residents already know - they pay for the maintenance of roofs, basements and porches. You will also have to pay for maintaining order in your yards. But for the already established order!
Thus, the state first helps with a lot of money for a long time to clean up the yard, and then this responsibility passes to the owners of the apartments.
The further fate of each court depends on the will of the inhabitants of the house. It is important that they understand: the territory of the yard will be included in the program only if they take the initiative. This is decided at a general meeting, where residents will be introduced to the list of minimum work that can be done in their yard.
The meeting must decide what kind of improvement should be made. If additional types of work are supposed, it is necessary to find out whether the residents are ready to participate in this materially and personally. At the meeting, a person is chosen who will further represent the interests of the residents of the house and monitor the safety of the acquired improvements.

If a decision is made to carry out additional work, then the number of people who are ready to participate in this should be clarified.
Participation may be:
- Labor. It is free and voluntary. This is participation in subbotniks, construction and paintwork, installation of bins and benches, landscaping, and cleaning of the territory.
- Financial. This means funds collected in the form of lump sum payments (the amount must be at least approved in the decision of the meeting), and the involvement of sponsors.
Meetings can be organized by: the board of the housing and communal services, a management company or initiative residents. For alerts, you can put up announcements indicating the summons, put alerts in mailboxes, and call in person. All decisions taken at the meeting are recorded in the minutes.

What is needed to include the local area in the improvement program
In order for a specific yard to be included in the program, the following actions must be performed:
- Create an initiative group.
- Make a list of desired changes.
- Design the layout of the yard with the proposed improvements.
- Hold a general meeting of residents, after which a protocol will be drawn up.
- Apply for participation in the program to the municipal authorities.
If, according to the cadastral passport, several houses are located in the local area, then the initiative group should include representatives of each of them.
The drawing indicates existing facilities and planned. The proposed innovations must be consistent with the municipal program. For example, installation in the courtyard of the monument may not be included there.
A positive decision is made if the majority of those present at the meeting voted for it. Following the meeting, a protocol is drawn up.
Then, an application for improvement is submitted to the municipality. The public commission created there will consider it and organize a public discussion. The municipal organization will submit for consideration a design project of the courtyard, which requires coordination with representatives selected at the general meeting of residents.
Based on the design project, the municipality will organize a competitive selection of contractors for the necessary work. Representatives from the initiative group carry out intermediate control over the progress of work.
Further maintenance of the yard in order may be carried out by the residents themselves or with the involvement of third-party organizations for an additional fee.
Participation in the program and a joint discussion of the details has an additional bonus - it is the rallying of people living in the same house.

As of the beginning of October, the program for comprehensive improvement of domestic territories was 91% complete. This was announced by Evgeny Khromushin, Minister of Housing and Communal Services of the Moscow Region.
“On behalf of the Governor of the Moscow Region A.Yu. Vorobyov, we have increased the pace of work on landscaping yards,” said Yevgeny Khromushin. Improvement of 1,440 domestic territories is planned for this year, work has already been completed at 1310 sites, which is 91% of this year's program. In 45 municipalities, the improvement program is 100% complete, in three municipalities 100% or more, the improvement of the remaining yards is in varying degrees of readiness from 75% to 95% and will be completed on time. ”
It should be noted that the urban districts of Reutov (122.2% overfulfillment), Elektrogorsk (114.3% overfulfillment) and Lyubertsy (101.5% overfulfillment) can be called the forerunners of the comprehensive yard improvement program in the Moscow region. Most municipalities have completed the program 100%, including Mytishchi, Podolsk, Balashikha, Shchelkovsky, Kolomensky, Shakhovskaya, Bronnitsy, Roshal, Pushchino and others. There are outsiders to implement the program, which are now in the red zone, including Protvino, Krasnoarmeysk, Dubna and Fryazino.

Beautification includes six mandatory elements: a new or upgraded playground with safety cover, landscaping, lighting, parking pockets, an information stand, a container area for municipal solid waste.
