In the latter case, the repayment of a housing loan does not occur at the expense of family members, but is carried out by the authorized federal district at the expense of government obligations to the program participant.
Rights of a participant in the accumulative-mortgage system
After three years from the moment of signing the contract for military service, the NIS participant gets the opportunity to dispose of the accumulated funds.
You can use them to purchase and register ownership of a home with a mortgage or other special purpose loan.
It is also possible to use the accumulated funds to improve housing conditions or to purchase housing according to the usual purchase and sale scheme without using borrowed funds.
Another right of the NIS participant is that a tax deduction is possible when buying an apartment on a military mortgage. That is, according to the Tax Code, a deduction of 13% is possible for the amount of additionally used funds when purchasing housing.
Regarding the use of additional funds, you can also use borrowed funds. That is, to the question that arises, if there is a military mortgage will they still give the usual mortgage to issue? The answer will be unequivocal that this is not prohibited by law.

The solution to the problem was the development of a conceptually new, financial form of housing for military personnel. On August 20, 2004, President of the Russian Federation Vladimir Putin signed federal law No. 117 “On the accumulative-mortgage system”.
117 Federal Laws entered into force on 01.01.2005 and allowed employees to purchase real estate at the expense of the Ministry of Defense, by attracting a targeted housing loan “TsZhZ”. The functional of the accumulative-mortgage system, in its simplest form, is a transfer of finances to a military serviceman. From the moment of joining the NIS, a fixed amount of money - “funded contribution” is transferred annually to the participant’s personal account.

At the same time, the funded contribution is subject to annual inflation indexation, and its size cannot be lower than that established a year earlier. For example, the cumulative contribution in 2017 was 260,141 rubles. In January 2018, the amount was indexed and reached the level of 268,465.6 rubles.
Benefits of Military Mortgages
Comparing the financial (NIS) and the natural form of housing for military personnel, we can distinguish the main advantages of the first:
- Dates. NIS, coupled with a military mortgage, allows a soldier to avoid long-term expectations and purchase an apartment after 3 years of participation in the system.
- The ability to choose. Participants gain access to the primary and secondary real estate market, up to the purchase of a townhouse or house along with a land plot. There are no regional restrictions, an apartment can be bought without “binding” to the place of service.
- Saving. Military personnel attract no more than 10% of their own savings when buying a home. In addition, they have the opportunity to purchase several apartments at the same time.
- Reusability. The law provides for the possibility of reusing military mortgages in case of early repayment of the loan. Married participants in the system have the right to pool savings, thereby increasing the cost of a potential apartment.
Separately, it is worth highlighting maternal capital. Families with 2 or more children may use the mat. capital to pay the down payment or early payment of a military mortgage. A similar opportunity was originally laid down in 117 Federal Laws, but until recently it remained unavailable.
Only in 2017, some partner banks of the Federal State Institution "Rosvoenipoteki" began to practice the use of maternity capital funds (etc. Bank ZENIT).
Who is eligible to join the NIS
- Military personnel who have contracted or graduated from a military school and received their first officer rank before January 1, 2005. In this case, it is possible to become a member on a voluntary basis by writing a report. If the contract was signed after the entry into force of 117 Federal Laws, the military must be entered in the register of NIS participants, with the right to use a military mortgage.
- Military personnel holding the rank of warrant officer, midshipman or foreman, who have entered the ranks of the reserve and have served for at least 3 years since 2005.
- Soldiers, foremen, sergeants or sailors who, after 2005, signed another contract and expressed a voluntary desire to join the state system.
At the same time, persons who have not used a military mortgage and are registered on a voluntary basis may refuse to participate. The procedure requires a statement of claim to the garrison court.
Registration mechanism
For inclusion in the register of the accumulative-mortgage system, a soldier needs to compile a report addressed to the unit commander. The application is sent to the NIS officer, who, in turn, is obliged to compile lists of potential participants and provide parts for consideration by the management.
The final step is the opening of a participant’s personal account by the Federal Treasury Institution Rosvoenipoteka, which oversees the work of the state system and the Military Mortgage program.
Note that the registration procedure should not exceed the statutory period of 3 months, after which the soldier must obtain a certificate of participation in the NIS.
From the moment of receipt of the certificate, FSUE "Rosvoenipoteka" transfers to the participant’s account a monthly accumulative contribution, for 2018 amounting to 22,372.1 rubles. At the same time, the right to take advantage of a military mortgage and a targeted housing loan (CHL) comes after 3 years of participation in the NIS.
Obtaining certificate ZHZZ
As already mentioned, after three years of participation in the funded mortgage system, a soldier gets the opportunity to use budget funds to buy an apartment.
To do this, you need to file a report in the name of the commander of the part about obtaining the right to use the target housing loan. The statement must indicate the need for better housing conditions.

Next, the paper is drawn up and brought to the participant of FSUE "Rosvoenipotekoy". The certificate contains information on the available size of the MRL and the parameters for calculating the military mortgage: the amount of accumulated savings, the size of monthly payments, the loan deadline. According to the law, the whole procedure should take no more than 1 month from the moment of submission of the report.
Validity of the certificate is six months. A serviceman will receive it 30 days after signing, so only 5 months remain to submit an application to the bank, register a mortgage and search for housing. The document will have to be re-requested if it expires.
The choice of bank and real estate market
After receiving the necessary papers from Rosvoenipoteka, a soldier can proceed with the selection of housing. You should start with the real estate market:
- Primary. It makes it possible to invest in the construction of a house, after the conclusion of an equity agreement. The option is attractive in that the housing on DDU is an order of magnitude cheaper, and the result obtained at the exit will exceed the initial investment at a price. However, shared construction is a risky move.
- Secondary. Purchase of finished housing and apartments previously owned by the owners. Military mortgages are often used to buy “resales”. Nevertheless, it is worth taking special care if the apartment has already changed more than 1 owner.
Once the type of market is selected, you should consider in detail the proposals of realtors and construction companies. By law, a soldier has the right to acquire:
- housing in an apartment building;
- a cottage that meets the established standards of living;
- townhouse or private house with a land plot;
- communal apartment.
It is important to know that for the first two types of housing, most banks provide a military mortgage. To townhouse and communal apartment - the number of banks is sharply reduced. Collection of documents for submission to the bank
When self-executing a military mortgage, a soldier must have the following documents with him:
- certificate of the NIS participant (see above) giving the right to use the CLP and soft loan;

- written consent to the processing of personal data;
- identity document (spouse or spouse's passport is optional);
- birth certificate of children (under 14 years old) or passport (after 14).
After submitting the documents, the bank carries out the verification procedure and then makes a decision regarding the serviceman. If the participant meets the requirements and the paper is in order, he is recognized as a borrower for a military mortgage, and a special bank account is opened in his name.
This account is intended exclusively for the funds of a targeted housing loan - there is no opportunity to withdraw cash.
Also, the soldier will be required data on the market value of the acquired property. The document is compiled by an appraisal company that has permission and the necessary licenses for this type of activity. The list of appraisers can be obtained from the employees of the bank in which the military mortgage was issued.
Documents for Rosreestr
The final stage when buying a home on a military mortgage is the provision of documents to the Federal State Registration Service. The main securities required by Rosreestr include:
- contract of sale of real estate;
- mortgage;
- targeted housing loan agreement;
- identity document;
- an agreement on the allocation of a military mortgage by a bank;
- notarized consent of the spouse to purchase a home;
- prenuptial agreement (if any) and marriage certificate;
- passport of the owner or seller of housing;
- notarized consent of the spouse of the seller;
- agreement of the guardianship authorities for the sale of housing (in rare cases, if the property is owned by children under 18 years of age or citizens with disabilities);
- application of a serviceman for registration of the right;
- application from the owner of the property for registration of transfer of right.
In some cases, Rosreestr may require additional information. To clarify the full list of documents, you should contact the office of the institution at the place of the transaction.

After registering the ownership right, the soldier needs to get an extract from the USRN, where information about the presence of a double burden on the housing (bank and state) will be noted. The actual amount available for acquiring housing on a military mortgage consists of several points: the funded part, annually credited to the account of a participant in the funded mortgage system; military mortgages provided by the bank; own money of a serviceman.
In order to use the funds accumulated in the account, it is necessary to issue a certificate of eligibility for a targeted housing loan. This can be done already three years after the inclusion of a soldier in the NIS program.

Secondly, you will have to pay for various related services: real estate appraisal and paperwork (for example, sales contracts and targeted housing loans).

Payment of insurance premium is the obligation of a citizen of the Russian Federation. Regardless of the cost of paperwork, the insurance participant will have to pay the insurance premium out of pocket. And this, no less, an average of 5,000 rubles a year.
Rosvoenipoteka explained that insurance payments are a citizen’s obligation that is not related to NIS. “This is a requirement of the mortgage law. Any citizen of the Russian Federation, registering a dwelling under a mortgage agreement is obliged to insure property and conclude a property insurance contract for housing.

The amount of savings does not depend on the size of the family. The total duration of approval and execution of all necessary documents in the bank can reach 2 - 4 months.
Indexing of annual accruals to a member of NIS
Let us return to the annual accruals to the account of the NIS participant, which go to repay the mortgage. According to the military, the bank initially pledges an increase in annual payments.
But no one knows for sure whether the indexation of the annual accrual to the NIS participant’s account will correspond to an increase in the amount of payments, which means that it is quite possible that the military will have to pay the difference at its own expense. Doubts are also caused by the fact that in 2016 the funded contribution was not indexed, although in 2008–2015 the amount was indexed annually.
In "Rosvoenipoteka" emphasized that such a situation could not arise. Payments are made in accordance with the schedule approved when applying for a loan.
“The amount that the state pays is approved annually by the Federal Budget Act. The state pays 1/12 of this amount monthly. The bank calculates the payment on the basis of the amount set in the budget, ”the source said.
The apartment is easy to lose
Perhaps the most important risk when buying a home under a military mortgage program is the fact that a military man can easily lose his apartment upon early dismissal from service, even if the dismissal happened for reasons beyond his control (for example, in connection with the dissolution of the unit).
In case of dismissal with a term of service of less than 10 years, the NIS participant must return all of the funds allocated to him for the purchase of housing by ZHZ from his own pocket, and repay the remaining loan independently.

If the military service is more than 10, but less than 20 years, then the used accumulative funds remain with the military, however, the NIS participant pays the rest of the loan on its own.
If a military man with a length of service of more than 10 years is dismissed on preferential grounds, then he has no financial obligations to the bank - the state will repay the mortgage. The “valid” grounds for dismissal may be a reduction in the military unit, health problems, or reaching the age limit of 45 years.
Upon termination of employment for more than 20 years, funds ZHZZ not subject to return. Additional documents from the spouse
