Andrey vdovin banker of the latest publication. Andrei Vdovin is charged with a particularly large fraud
Former first vice-president of Fondservicebank Petr Ladonshchikov, arrested together with the ex-owner of this credit institution Alexander Volovnikov, on charges of embezzling 1.38 billion rubles belonging to Roscosmos, entered into a pre-trial cooperation agreement. As part of the deal, he testified about how and to which companies exactly 6 billion rubles were withdrawn from the bank on behalf of its former owner. A Kommersant source close to the investigation notes that after studying the testimony of Mr. Ladonshchikov, the owners of the firms involved in the scam may be brought to criminal responsibility, and Mr. Volovnik faces a more serious charge of organizing a criminal community.
Unlike former owner and the president of Fondservicebank Alexander Volovnik, who denies his guilt, Mr. Ladonshchikov immediately admitted it, starting to actively cooperate with the investigation. Subsequently, Mr. Ladonshchikov officially formalized his cooperation with the investigation, having signed a pre-trial agreement with the Deputy Prosecutor General of the Russian Federation Viktor Grin. Now, according to the law, his case should be separated into a separate proceeding, and he himself can be transferred from the pre-trial detention center to house arrest.
As a reminder, a criminal case on embezzlement of Roscosmos funds deposited in Fondservicebank was initiated in August 2015. According to the preliminary investigation, Mr. Volovnik organized the theft from the bank of at least 1.38 billion rubles, which were withdrawn, including abroad, through one-day companies that received bad loans. At the end of April, Mr. Volovnik and the alleged accomplice of the embezzlement Pyotr Ladonshchikov were arrested by the decisions of the Tverskoy District Court, to which representatives of the Investigative Department of the Ministry of Internal Affairs applied. Now a Kommersant source claims that thanks to the testimony of Mr. Ladonshchikov, the amount of the alleged embezzlement has grown to 6 billion rubles, and in addition, companies that received bad loans from the bank and employees of the bank itself involved in the scam have been identified. "The decision on which of them will become the new accused in the case, and who will retain the current status of witnesses, will be made depending on their testimony," a Kommersant source said.
It is worth noting that the preliminary investigation, which was first conducted against unidentified persons under Part 4 of Art. 159.1 of the Criminal Code of the Russian Federation (fraud in the field of lending) and was investigated rather sluggishly, at the beginning of this year, after the intervention of the Prosecutor General's Office, it sharply intensified. The classification of the crime was changed to Part 4 of Art. 160 of the Criminal Code of the Russian Federation (embezzlement committed on an especially large scale with the use of official position), and at the end of April, the first alleged participants in the embezzlement, Messrs. Volovnik and Ladonshchikov, were in the pre-trial detention center. Now, as a Kommersant source close to the investigation suggests, after a comprehensive check of the testimony of Mr. Ladonshchikov and the probable arrests of other participants in the embezzlement, the ex-owner of Fondservicebank, Alexander Volovnik, may be charged with a more serious Part 1 of Art. 210 of the Criminal Code of the Russian Federation (organization of a criminal community).
Meanwhile, the defense of Messrs. Volovnik and Ladonshchikov appealed against their arrests in the Moscow City Court. Representatives of the first of them insisted that the crime he was charged with was committed in the course of entrepreneurial activity, offering to transfer the banker from the pre-trial detention center to house arrest. The lawyers of the second argued the need for house arrest by the fact that the Tverskoy District Court did not take into account the repentance of the accused and his assistance to the investigation. However, the appellate instance left the bankers in custody.

Thanks to the testimony of Mr. Ladonshchikov, Interior Ministry officers detained three businessmen who were involved in the disappearance of funds.
The official representative of the Ministry of Internal Affairs Irina Volk said that the employees of the Main Department economic security and combating corruption (GUEBiPK), as well as other police units, carried out a set of operational-search measures in a criminal case on the withdrawal of more than 1 billion rubles from the space industry.

“To extend the term of detention in respect of Volovnik for three months,” Judge Maria Sizintseva read out the ruling.
The court also extended the term of detention in relation to the former vice-president of the bank, Petr Ladonshchikov, who is accused in this criminal case.
The court leaves the ex-head of Fondservicebank Volovnik under arrest in the embezzlement case
MOSCOW, 1 Feb - RAPSI. The Moscow City Court recognized the decision to extend the arrest of the former president of Fondservicebank Alexander Volovnik, accused of embezzlement, as lawful, the press service of the court told RAPSI.
Thus, Volovnik will remain in custody until March 25. Also, the court upheld the decision to extend the term of detention in relation to the former vice-president of the bank, Petr Ladonshchikov, a defendant in the same criminal case.
According to the investigation, Volovnik was involved in the embezzlement of about 50 billion rubles placed in the aforementioned bank by the state corporation Roscosmos. Investigators believe that Volovnik and Ladonshchikov provided firms with deliberately bad loans, and the money was withdrawn abroad. The defendants do not admit their guilt in the accusation.
Despite the accusations of the former leaders of Fondservicebank Volovnik and Ladonshchikov that they had kidnapped, laundered or cashed in 6.5 billion rubles, the ex-bankers were placed under house arrest.
According to Kommersant's information, the Investigative Department of the Ministry of Internal Affairs suspected the former president Fondservicebank Alexander Volovnik and ex-president of the financial structure Pyotr Ladonshchikov in organizing a criminal community (part 1 of article 210 of the Criminal Code of the Russian Federation). Another 11 persons involved in the investigation of the Ministry of Internal Affairs may be charged with participation in an organized criminal group.
As Ruspres reported, a year ago Peter Ladonshchikov , arrested together with the ex-owner of the credit institution Volovnik, concluded a pre-trial cooperation agreement. As part of the transaction, he testified about how and to which companies from the bank, on behalf of its former owner, "Roscosmos" 6.5 billion rubles.
Gentlemen Volovnik and Ladonshchikov spent almost a year in custody on charges of particularly large embezzlement or embezzlement (part 4 of article 160 of the Criminal Code) and were supposed to be released. New suspicions made it possible to keep them in a pre-trial detention center until the trial was considered by the court on the merits for up to one and a half years. However, the Moscow City Court yesterday refused the investigation to extend the term of detention of the accused, ordering to transfer them to house arrest. According to the source, the main investigative actions with their participation may be completed in July, after which the defendants will begin to get acquainted with the materials of the investigation.
The two main defendants in the investigation, Volovnik and Ladonshchikov, recall that arrested back in the spring of 2017 ... In November of the same year, three more were detained - businessmen who, according to the investigation, helped the former heads of Fondservisbank to withdraw money through the accounts of their firms. Large amounts of cash were seized in the course of searches in the offices of these merchants. Businessmen, like ex-bankers, were taken into custody. But the seven new defendants, who appeared in March of this year, were not imprisoned by the investigators, having taken from them recognizance not to leave the place and proper behavior. According to some reports, such a humane attitude towards the alleged participants in the embezzlement and organized crime groups is explained by their insignificant roles in the incriminated crime, as well as cooperation with the investigation.
A criminal case on embezzlement of Roskosmos funds placed in the Fondservicebank, which is the main one for the rocket and space industry, was initiated in August 2015. At that time, about 47 billion rubles belonging to Roskosmos, some of which disappeared, “hung up” in the financial structure.
Initially, the investigation established that Mr. Volovnik organized the theft from the bank only 1.38 billion rubles , which were withdrawn, including abroad, through one-day companies that received bad loans. However, after the arrest of Mr. Volovnik and his deputy Ladonshchikov, the amount of the alleged embezzlement increased to 6 billion rubles, and later, after interrogations of businessmen connected with the bankers, the amount increased by another 600 million rubles. In addition, during the interrogation of the new defendants in the case, the companies that received bad loans from the bank and the employees of the bank itself who participated in the scam were identified. As a result of the processing of this information, new persons appeared - the owners of one-day companies, who were included in the criminal chain of cashing out or laundering money stolen from the bank.
It should be noted that the investigation of the Fondservicebank case was rather sluggish at first. Only after the intervention of the Prosecutor General's Office at the end of April 2017 did the investigation sharply intensify. It was then that the alleged organizers of the thefts, and now the OPS, Messrs. Volovnik and Ladonshchikov, ended up in the SIZO.
The lawyers of Messrs. Volovnik and Ladonshchikov, commenting earlier on the accusations of the ex-bankers of embezzlement, argued that their clients were not guilty of anything. Supposedly they were engaged exclusively entrepreneurial activity... The defenders refused to discuss suspicions of organizing an organized criminal community.
At the same time, it should be noted that ex-managers of Fondservicebank will no longer be able to compensate for the damage incriminated to them. The fact is that at the end of last year, Arbitration court Moscow, Alexander Volovnik was declared bankrupt - he owed 7.8 billion rubles to VTB, about 170 million rubles -
Co-owner of the Asian-Pacific Bank (ATB) and one of the former owners of Azbuka Vkusa, Andrei Vdovin, may be declared bankrupt. On August 14, the Deposit Insurance Agency (DIA), the bankruptcy manager of the collapsed Finprombank, filed an application to the court to declare him financially insolvent. The businessman owes him $ 11 million on the loan. Vdovin himself denies the existence of a debt, writes Kommersant.
According to the newspaper, Vdovin was a major borrower of Finprombank (September 19, 2016). And, as the DIA assures, until now, despite the measures taken by the liquidator, the debts have not been paid off.
“According to the inventory of the property of Finprombank, at the time of the opening of bankruptcy proceedings on its balance sheet, the debt of Andrey Vdimovich Vdovin was taken into account. credit agreement with a principal debt of $ 11 million, the DIA press service told the newspaper. - Return money should have been carried out on September 30, 2016, but so far, the obligations to the bank have not been fulfilled. "
A long period of default, the lack of actions aimed at settling the debt are sufficient grounds for applying measures to the borrower enforcement, including as part of the bankruptcy procedure, are confident in the DIA. However, Vdovin, according to the statement of his representatives, considers the claims of the DIA to be unfounded.
“This lawsuit is completely insolvent: currently Vdovin has no financial relationship with Finprombank,” the official representative of Vdovin assured the publication. - All previously existing financial obligations to Finprombank were terminated in September 2016, all supporting documents were repeatedly submitted to the bankruptcy commissioner.
The DIA insists that during the bankruptcy proceedings in the bank, no action was taken on the part of Vdovin to pay off or restructure the debt.
It will not be easy to seize Andrey Vdovin's property. According to the materials of the Khamovnichesky District Court of Moscow, he is in the process of divorce and division of property from his wife Sophia, a famous Russian golfer. According to a source familiar with the situation, the spouse will receive the overwhelming majority of the property. The claim for the division of property, judging by the court's data, was filed on behalf of the wife almost immediately after.
Nevertheless, the bankruptcy procedure makes it possible to establish reliable information about the debtor's property and prevent its alienation, lawyers emphasize. In addition, the bankruptcy procedure can significantly reduce the collection period and the bank's costs for litigation, the DIA concludes.
Until the end of 2016, Vdovin was a co-owner of the Azbuka Vkusa supermarket chain. He is also still one of the largest shareholders of ATB. In connection with the collapse of ATB's subsidiary M2M Private Bank last December, Vdovin and his partners Alexey Maslovsky and Peter Hambro, at the request of the Central Bank, are looking for a strategic investor for the bank.
Legal company Paradigma, representing the interests of Andrey Vdovin, announces the termination of Finprombank's claims against the banker. "With proper study primary documents The DIA, obviously, could establish that the claims of Finprombank against Andrei Vdovin had long been terminated. No one took into account that at present Finprombank has no documented rights of claim against Andrei Vadimovich. Based on the foregoing, it follows that filing an application for declaring him bankrupt is, most likely, an instrument of pressure from the bank and the DIA in order to present Andrey Vdovin in the most negative light, maliciously evading the fulfillment of obligations, "the Bank said in a statement. .ru comments of the law firm.
Vdovin's defense promises to present irrefutable evidence proving the absence of any legal basis for the bank's claims to the court session.
