Home Money. One of the oldest players in the microfinance market, Domashniye Dengi, signed its inability to execute an offer on bonds in the amount of 1.25 billion rubles. But in any case, it does not matter: creditors can demand a return of funds through the court, which will certainly support their positions.

If a technical default is declared, the issuer will have 30 days to settle its financial problems and prevent a default from becoming real, followed by bankruptcy. Alternatively, the MFI may invite creditors to waive their legal rights, but they may still demand performance of the obligation. Some experts believe that the problems of Home Money, which specialized in issuing instant loans and has long been the leader in the credit market, are due to the reluctance of banks to open or prolong current credit lines. According to a representative of MoneyMan, they also faced such a problem when they were denied even opening a corporate account. But in general, other market participants believe that the bankruptcy of Home Money will still not entail serious consequences. There is no panic among MFI investors, and they do not believe that if one MFC has a problem, other lending companies should also have to.
It should be noted that the MFO "Home Money" actively attracted funds from legal entities and individuals in the amount of at least 1.5 million rubles, which is provided for by the norms of the relevant legislation. All these and other types of services must be actually paid on the day of treatment. The travel agency is not entitled to insistently ask for a non-refund if the costs are laid down as dangers or as potential payments. Such payments are assigned to the contractor conducting its own commercial activities, taking into account personal business risk.
Determining the return amount
The amount to be refunded for a canceled trip depends on the factor in which this decision is made. A valid root cause allows you to receive all the finances paid.
However, the customer does not always require the receipt of their own money. It is likely that the date of departure will be changed to another date agreed by the parties. At the same time, when the travel agency has already incurred certain expenses, it will reimburse its own expenses from the funds paid. This provision is expressly included in Art. 32 of the Federal Law on consumer protection.
The agency will try to protect itself from possible financial losses, as a result, it takes into account the withholding of compensation from its own customer.
Therefore, it will not be easy to achieve 100% compensation of funds, since the company has already been able to pay for hotel reservations, insurance payments and other expenses.
Remember! A number of tour operators include in the contract such requirements as:
- if the trip is canceled for 30 days or more, the entire amount of the trip is subject to compensation;
- when the refusal is made in 20-25 days, 90% is supposed to be issued to the customer;
- in 2-3 weeks - 70%;
- for 1-2 - 50% of the cost;
- when less than 7 days before departure - the customer loses all the money.
These requirements are considered indicative. Each travel agency includes in the contract points that are considered important. If the trip is interrupted due to a travel agency, the finances for the ticket are subject to compensation in full.
However, in practice, this is rare, since there are a large number of injured clients, and the travel agency has already incurred waste. In this case, the failed tourist will receive less from 5 to 25% of the total cost.
When to go to court
How to reimburse the finances for a tour if the travel agency, in the opinion of the client, clearly unfairly limited the payment or even deviated from it? In this situation, you should look for a competent lawyer for economic conflicts or directly in the field of service provision and consumer protection.
Another option is to contact the state structure - Rospotrebnadzor. In the latter case, a check can be made, and the company will be obliged not only to compensate the cost, but also a fine to the state if it acted illegally.
If the voucher was canceled in advance, then according to the requirements of the contract, signed and sealed and signed, the return of funds must be mandatory.
Among the finances to be returned are all expenses actually not incurred by the travel agency. Such a list may include the return of finances for excursions, meals, hotel reservations. The general list is not limited.
Returning a ticket to a travel agency is not the only way out of the situation. The customer can also be offered to reschedule the dates of the trip. This is the most painless and satisfying method for both parties to end the dispute.

The legislation upholds the right of the consumer to withdraw from the purchase of travel offers. But at the same time, he also has an obligation to pay the expenses incurred by the travel agency.

Rights of a surviving spouse in legal inheritance

The term will in jurisprudence has many definitions.
A will is an act of the unilateral will of a person, which fixes his order regarding the sale of property and related personal non-property and property rights and obligations in the event of death. What does representational inheritance mean?
The right of grant (PP) is the opportunity for descendants to become official and fully entitled heirs instead of their parents upon the death of the parents before the person who left the ancestral property. For example, if the son of a deceased father died earlier than he did, while leaving children behind, then during the distribution of the inheritance, part of the property belonging directly to him will go only to his children, who are the grandchildren of the testator (that is, the deceased grandfather). But in life there are a large number of situations in which there are no heirs of the first stage. In such situations, the potential heirs are the sisters and brothers of the deceased. PP is also used in relation to those relatives who occupy the third line of inheritance. In such cases, cousins and brothers may enter into their legal inheritance.

For example, if there is at least one applicant for inherited property from the first priority, all other relatives belonging to subsequent queues will receive nothing at all.
Relatives of only 1-3 stages are capable of claiming inheritance on the basis of PP. As in ordinary queues, the further a relative is in line, the less likely he is to get at least something.
When inheritance under PP is impossible
Life is far from always fair, especially when it comes to inheritance under the PP. And such inheritance is not carried out in two situations: within the framework of judicial proceedings or by law. It is worth considering both situations in more detail.

Grandchildren are not able to become heirs in such cases:
- The living parent is the one who gets the share of the inherited property.
- The parent died almost immediately after the inheritance was opened.
- In the will, the principal heirs were disinherited.

How inheritance is regulated by law
According to the norms and laws of the Civil Code of Russia, all real and all movable property of the testator, as well as all his property rights, will have to be transferred to the heirs of the first stage. The procedures for the distribution of hereditary property are defined and regulated by some articles of the 63rd chapter of the Civil Code of Russia.
Who are the heirs of the next stage, what are the features of heirs and inheritance
The civil code defines the concepts disclosed in the commentary to article 1145 of the same regulatory legal act.
The current laws of the Civil Code of Russia, including the institutions of inheritance, in most cases are based on the principle of Roman private law. For example, the determination of the degree of kinship between the ancestral party and its numerous descendants depends on the total number of generations.
Modern laws of the Civil Code of Russia provide similar rules for determining kinship by counting the total number of births that have occurred since the birth of the testator and before the birthday of the heir, whose degree of kinship is subject to mandatory establishment.
The presence of as many as seven lines of inheritance is a novelty of the modern Civil Code, because all previous versions of this act of lawmaking do not have more than 4 levels.
Increasing the circle of persons by adding several lines of inheritance speaks of strengthening property civil rights, in the form of one of the key fundamental constitutional principles of the inviolability of property.
What rights do those persons who are heirs of all subsequent stages have
The sequence of acceptance of inherited property is a sequence regulated by law, according to the rules and basic principles of which the inheritance is transferred from the testator to relatives, provided that there is no will.
In the event that the heirs of the first category did not or could not exercise their rights within a certain and allotted by law period, all property rights and property of the testator pass to the relatives of the next stage.
The implementation of inheritance rights to inherited property by at least one relative from the previous stage automatically deprives all representatives of all subsequent stages of any opportunity to receive inherited property or even at least part of it, because the distribution of inheritance between relatives of different stages is not provided for by the norms of the current legislation.
Under what conditions inheritance rights are transferred to relatives of subsequent stages
So, the heirs of each successive order inherit if it is legally possible. According to the norms of the legislation, the right to receive an inheritance passes to the representatives of each successive stage, subject to the following conditions:
- Absence of successors of the previous line.
- The heirs of the previous stages were deprived of their rights both by the testator and in accordance with the law.
- The heirs of the previous stages refused to accept the inheritance or did not accept it.
In this case, the refusal to accept the inheritance is carried out with the help of an appropriate application, in which there is no indication of the one in whose favor the refusal was made. And in case of non-acceptance of the inheritance, there are no statements at all.
Representatives of the heirs of the next stages. Order of succession
So, after the third turn, the following turns come:
- Fourth: great-grandmothers and great-grandfathers of the testator.
- Fifth: great-aunts / grandfathers / grandchildren / granddaughters. Also, the same line includes the grandchildren of brothers and sisters of the testator.
- Sixth: grandchildren of sisters / brothers / uncles / aunts of the testator, and also sisters / brothers (cousins) of the testator's parents.
- Seventh: such non-native relatives as stepdaughter, stepson, stepmother and stepfather.
The peculiarity of the seventh stage is that its representatives are not blood relatives for the successor party. Of course, relatives of the seventh stage will be able to receive an inheritance only if relatives and possible future heirs for some reason cannot receive an inheritance or refuse it.
How is property distributed among the heirs of subsequent stages
According to the law, the property must be distributed among the heirs of the same order equally. But it is important to consider whether the property was the property of the testator, or whether it was joint common property acquired during family life.
After all, if we are talking about private property, there will be no problems, because all those persons who are heirs of one line will receive property in equal shares. If this is common property, then it is necessary to separate the part that really belongs to the testator from the part of the property that belongs to the spouse. Needless to say, when a personal manager comes home to a borrower-debtor, he tries in every possible way to humiliate him, calls him a fraudster, threatens the Criminal Code of the Russian Federation, etc. An MFI employee does not hesitate to even walk around the neighbors and tell everyone that Vasya Pupkin from apartment 9 is an ardent defaulter, swindler and debtor.
The pressure does not stop in social networks: VKontakte, Odnoklassniki, Facebook. If the Security Council was lucky enough to find the personal page of the debtor, then all his friends will receive daily messages that the debtor is wanted - Vasya Pupkin, who is a scammer, deceiver, scoundrel, etc.
After about 1-2 months of unsuccessful reproaches, threats, conversations and screams, the same manager arrives at the place of residence of the borrower in the company of 3-4 pumped-up guys. It is noteworthy that the brave guys stand quietly on the sidelines, not taking any action, while the manager is diligently trying to put pressure on the conscience / pity of the borrower.
If the intimidating appearance of sports guys does not bring results, the next time they are talking to the borrower. No, they don’t let go of their hands, to beat - they don’t beat anyone, but they threaten, remembering the family.
The Home Money Company doesn't stoop to physical assault (as far as we know), but even if talking to jocks doesn't work, they go back to hourly calls. And about the 6th month, a “good guy” calls, introduces himself as the head of the security service for such and such a region and calmly asks what the problem is, why there are no payments, etc.
Here the borrower begins to tell him his tearful story, and the uncle offers to cut off part of the debt (20-30%) by paying the entire amount within a few days. At this stage of collection, about 20-25% of borrowers return their debts in the hope of saving at least something, because they still have to pay.
If the persuasion of the head of the Security Service does not help, "heavy artillery" is used - a mass mailing of impartial letters to all mailboxes of the entrance in which the debtor lives. These letters contain a photograph of the borrower taken from passport data or social networks, indicate his personal data and address of residence, it is written that he is a debtor and a fraudster.
It is worth remembering that the methods and procedure for the described actions may vary depending on the region of residence of the borrower. Each city has its own managers, and in different regions - the Security Council, which has its own understanding of how to collect a debt, and it is necessary to collect it, because without this they will not receive anything. Both collection agencies do not take any effective measures to collect the debt, except for daily calls with persuasion, threats and weekly letters from the head office in Moscow. Now the question "Where to get the money?" it's time to ask the company itself. And for her creditors, another question is relevant: “Where, in fact, did the money go?”
A lot becomes clear if you just open the latest reports of Home Money, i.e. the results for the first quarter of 2018 according to Russian standards: there is no more recent information. From these statements, for example, you can find out that over the past two years the company has increased the provision of loans to legal entities by 6 times: from 2.15 billion to 12.64 billion rubles. During the same time, it reduced the portfolio of loans to the population from 5.58 billion to 0.43 billion rubles. What kind of companies lent Home Money and where did the retail portfolio go?
The statements say that as of December 31, 2017, the company issued a loan to the Cypriot Reluzo Trading Limited in the amount of 6.92 billion rubles. Scrolling through a few more pages, we find out that Reluzo Trading Limited is an affiliate, and looking into the register, we find that the ultimate beneficiaries of this company are Evgeny Bernshtam and his wife. They also own 100% Home Money.
Where is the other 5.7 billion rubles? The statements indicate that 5.22 billion rubles. in the form of a loan was received by the company "Home money service". This company was created as a subsidiary, and, judging by the statements, overdue debts were grouped on it. Toward the end, you can find that on the balance sheet of the Home Money Service company there was a debt of borrowers-individuals for 15.97 billion rubles, of which the principal debt accounts for just 5.2 billion rubles. And everything else - 10.77 billion rubles. are accrued interest. In 2016, there was a similar story, only then the main debt was 7.2 billion rubles, and interest accumulated by 5.8 billion rubles.
Here, in general terms, is the answer to the question of where the money has gone. Although it is not clear why everything was done this way: the reporting does not give an answer to this question. Another question remains open: where to get this money now to pay off creditors. Bernshtam has already offered his own answer to creditors: to create a new company and exchange debts to Home Money for its shares. And this company will earn money and return debts.
There is one more question, but it is no longer for the businessman Bernshtam, who solves problems as best he can, and not for those who bought Home Money bonds without reading the financial statements. This is a question for the Central Bank, which has been supervising microfinance institutions since 2013: after all, it is customary in the financial community to grumble about banking supervision.

- Transfer all property to another person. The method may work, but then the required amount will be deducted from the salary. If there is no work, then a forced employment will be offered, from the salary of which the amount of money will also be withheld. It should be borne in mind that such transactions can be challenged in court.
- Take another loan, for example, in another MFI. You still have to pay for a new one, but not immediately.
- Hide. After filing a lawsuit by collectors, quit their job, close existing accounts, move to another city with their family, while not fixing their location anywhere - work unofficially. You will have to hide for at least 3 years - this is the term of the statement of claim. If during this period the location of the debtor becomes known, the court will issue a tougher ruling. After 3 years, no one is looking for a person and no one requires debts.
Reasonable borrowers do not get involved in adventures, but seek help from law firms that can advise or represent the interests of a person at the stage of pre-trial and trial proceedings.
If you hire a good lawyer and sue the Home Money MFI, you can try to protest all the accrued pennies, or get rid of the loan altogether, arguing that the deal with the MFI was initially unprofitable due to high interest rates and a short repayment period.
