The new edition of Article 395 of the Civil Code of the Russian Federation establishes that the amount of interest is determined by the rates that took place in the relevant time periods, and not on the day the lawsuit is filed or on the day the decision is made, as was established in the previous version of this norm. Therefore, for each delay period, the calculation is based on the average rate (rates) of bank interest in this period, and if the rate for the corresponding period is not published, based on the latest of the published rates.
Interest is calculated at the rate prevailing in the federal district in which the creditor's place of residence (location) is located. If the creditor is a person whose place of residence (location) is outside the Russian Federation, the calculation is carried out at the rate prevailing in the federal district at the location of the court hearing the dispute.
Within the meaning of paragraph 3 of Article 395 of the Civil Code of the Russian Federation, interest on the use of other people's funds is charged inclusively on the day the amount of these funds is paid to the creditor, unless a shorter period is established for the calculation of interest by law, other legal acts or an agreement.
