Construction - a key term for the industry of the same name, denoting the process of erection of buildings and structures. This is a very broad concept that also includesoverhaul andrestoration ... The main difference between construction and renovation is not only in the scope of the concepts. Usually, construction is understood as the construction of an object from scratch, which, accordingly, requires a lot of preparatory work - this is design, off-site and on-site work, specific approvals, etc. When developing, it is necessary to take into account such factors as geodetic conditions, the presence of adjacent buildings, features of urban planning zoning and much more.
Reconstruction is carried out at a ready-made object, therefore, during the reconstruction, the characteristics of this particular object are taken into account first. The construction ends with the commissioning of the constructed building or structure. The purpose of the reconstruction is to restore the object and often to adapt it to use in new conditions. As a result of the reconstruction, the main technical and economic characteristics of the building change.
The term "reconstruction" must also be distinguished from the term "major repairs". According to the Urban Planning Code of the Russian Federation, overhaul, unlike reconstruction, does not change the main indicators of the object. After reconstruction in buildings and structures (including linear objects), for example, the building area, construction volume, number of floors, useful area may increase. It is believed that the terms of reconstruction and major repairs should coincide, but in practice, reconstruction requires more approvals and permits, which must be obtained from various authorities. Overhaul changes the building only in the sense that it removes physical or moral deterioration. As part of a major overhaul, the repair of the building's internal communications, repair of the foundation, basement, roof, walls, facades, elevators and elevator shafts can be carried out. Also, the list of repairs can be expanded by such items as: insulation of facades, installation of metering devices, device of exits to the roof, etc. Another task of overhaul is not only to negate the existing physical and moral deterioration, but also to bring the building or structure in line with modern standards.
Construction, reconstruction and overhaul works- it is not always easy to draw a distinction between them. Given that the construction industry is constantly being enriched with new materials and technologies, sometimes disputes arise as to whether the characteristics of the building have changed as a result of the work carried out and whether they relate to reconstruction or overhaul (for example, replacing wooden floors with reinforced concrete ones). To prevent construction stops and to solve problems associated with different understanding of the concepts of reconstruction and overhaul, legal literacy is required, especially in the field of capital construction.

Repair work, as a rule, depending on the frequency of carrying out, is divided into two types: maintenance and overhaul.

Definition of the concept of "overhaul" in the normative legal act

Overhaul of buildings and structures includes work on the restoration or replacement of individual parts of buildings (structures) or entire structures, parts and engineering equipment due to their physical wear and tear and destruction for more durable and economical ones that improve their performance ( Resolution of the Gosstroy of Russia dated 05.03.2004 N 15/1 (as amended on 16.06.2014) "On approval and implementation of the Methodology for determining the cost of construction products on the territory of the Russian Federation" (together with "MDS 81-35.2004 ...")).
Overhaul of the building- a complex of construction and organizational and technical measures to eliminate physical and functional (moral) wear and tear, which do not involve changes in the main technical and economic indicators of a building or structure, including, if necessary, the replacement of individual or all structural elements (except for non-replaceable ones) and engineering systems equipment with their modernization. Overhaul of an apartment building
Overhaul of an apartment building- carrying out and (or) providing the works and (or) services provided for by this Federal Law for eliminating faults of worn out structural elements of the common property of owners of premises in an apartment building (hereinafter referred to as common property in an apartment building), including for their restoration or replacement, in in order to improve the operational characteristics of common property in an apartment building ( Article 2 of the Federal Law of 21.07.2007 N 185-FZ (as amended on 23.06.2016) "On the Fund for Assistance to the Reform of the Housing and Utilities Sector").
Overhaul of the common property of an apartment building: a set of works (services) for the replacement and (or) restoration (repair) of structures, parts, engineering and technical support systems, and individual elements of the load-bearing structures of an apartment building that have lost during operation, which have lost their bearing and (or) functional capacity to similar or other improving indicators up to their standard state, when the volume of such work exceeds the current repair ( )
Overhaul types
Complex and selective overhaul
Overhaul is subdivided into complex overhaul and selective overhaul.
a) is a repair with the replacement of structural elements and engineering equipment and their modernization. It includes work covering the entire building as a whole or its individual sections, which compensates for their physical and functional wear and tear.
b) is a repair with full or partial replacement of individual structural elements of buildings and structures or equipment, aimed at full reimbursement of their physical and partially functional wear and tear.

Complex overhaul: replacement, restoration and (or) repair of the common property of an apartment building or its individual parts, made in relation to most of the common property of an apartment building ( "GOST R 51929-2014. National standard of the Russian Federation. Services of housing and communal services and management of apartment buildings. Terms and definitions" (approved and put into effect by Order of Rosstandart of 11.06.2014 N 543-st)
Complex overhaul- covers all elements of the building, provides for the simultaneous restoration of all worn out structural elements, engineering equipment and an increase in the degree of improvement of the building as a whole, eliminates physical and moral deterioration. Carrying out the next comprehensive overhaul of a building or structure is inappropriate if it is planned to demolish or relocate buildings or structures in connection with the upcoming construction of another building or structure on the site they occupy, reconstruction of the building is supposed, or the dismantling of the building due to general dilapidation is planned. In these cases, work should be carried out to maintain the structures of the building or structure in a condition that ensures their normal operation during the appropriate period (before demolition or reconstruction) ( )
Selective overhaul: replacement (restoration) of the common property of an apartment building or its individual parts, carried out in relation to a smaller part (some parts) of the common property of an apartment building ( "GOST R 51929-2014. Selective overhaul- covers individual structural elements of a building or its engineering equipment, while eliminating physical wear and tear of individual elements and technical systems of the building. Selective overhaul is carried out in cases where a comprehensive overhaul of a building can cause serious interference in the operation of the facility, with significant wear of individual structures that threatens the safety of the remaining parts of the building, when it is economically inexpedient to carry out a comprehensive overhaul according to the restrictions given in the definition of a comprehensive overhaul ( Resolution of the Moscow Government dated 09.29.2010 N 849-PP (as amended on 07.07.2015) "On approval of the Regulations for the overhaul of real estate objects owned by the city of Moscow and transferred to trust management")

Overhaul of external engineering communications

Overhaul of roads
Overhaul of the road- a set of works on the replacement and (or) restoration of structural elements of the highway, road structures and (or) their parts, the performance of which is carried out within the established permissible values and technical characteristics of the class and category of the highway and during the performance of which the structural and other characteristics of reliability are affected and safety of the motor road and the boundaries of the right-of-way of the motor road ( Art. 3 of the Federal Law of 08.11.2007 N 257-FZ (as amended on 07.02.2017) "On highways and road activities in the Russian Federation and on amendments to certain legislative acts of the Russian Federation")

The term of the overhaul. Reasonable time
The timing of the overhaul is either established by the parties, or established by regulatory legal acts (NLA). If there is no indication of the timing of the repair in the contract or regulation, then it is carried out within a reasonable time.
The concept of a "reasonable time" is traditional for civil law and is mentioned repeatedly in the provisions of the Civil Code of the Russian Federation (see Art. 314 of the Civil Code of the Russian Federation, in relation to pledge relations - clause 4 of Art. 345, clause 1 of Art. 358 of the Civil Code of the Russian Federation).
A reasonable time frame for major repairs depends on the condition of the property, its properties, climate characteristics, features of major repairs, technical capabilities and other reasons.
In addition, the normative legal act may provide for both specific terms for carrying out repairs, and the procedure for determining them can be fixed, and the frequency of performing certain types of repair work can be established.

I. Foundations

This list was formed on the basis of the revised lists of capital repairs recommended by the above regulatory documents within the framework of the types of capital repairs of apartment buildings defined by Article 15 of Federal Law N 185-FZ. At the same time, it is assumed that the provisions of these guidelines apply to apartment buildings subject to major repairs without stopping their operation. As a result of the overhaul, all the necessary work must be performed to bring the common property of an apartment building into a technically sound condition by restoring or replacing all parts of structures and engineering systems that have shorter service lives between regular (according to the standard service life) overhauls than bearing structures.

3. In the event that during the overhaul of structures and engineering systems as part of the common property of MD, due to the technological and design features of the structures and engineering systems being repaired, it is necessary to dismantle or destroy parts of the property that is not part of the common property of MD , work on its restoration is carried out at the expense of capital repairs, which should be provided for in the design and estimate documentation.
4. In the event that a heating system with a hidden pipeline laying is designed in an apartment building that is not repairable (Appendix 2), during the overhaul, it is allowed to re-install the heating system with an open laying of pipelines and heating devices, heating elements, including in living quarters.
The list of types of work in construction was applied from January 1, 2009 (since the introduction of the institute of self-regulation in the construction sector) and until July 1, 2017, when it was canceled in accordance with Federal Law No. the code of the Russian Federation and certain legislative acts of the Russian Federation ”(see details).

The main document regulating urban planning activities in the Russian Federation is the Urban Planning Code(Hereinafter - ГрК). It defines all its legal aspects - from the procedure for conducting engineering surveys to putting the facility into operation. It also describes the procedure for the development, coordination and approval of project documentation for buildings, structures and linear facilities.
All construction works are classified in a certain way, their misinterpretation can lead to financial losses or other undesirable consequences. One of the most controversial issues is the subject of this article.
So, let's consider the definitions of the concepts of overhaul and reconstruction:
Reconstruction of capital construction facilities(Article 1, paragraph 14 of the Civil Code) - changing the parameters of an object or its parts (height, number of floors, area, volume), including superstructure, reconstruction, expansion, as well as replacement and (or) restoration of load-bearing building structures, with the exception of replacement of individual elements of such structures with similar or other elements that improve the performance of such structures and (or) restoration of these elements;
The definition of the reconstruction of linear objects can be found in article 1, clause 14_1 of the Civil Code.
Overhaul of capital construction objects(article 1, clause 14_2 of the Civil Code) - replacement and (or) restoration of building structures of an object or elements of such structures, with the exception of load-bearing building structures, replacement and (or) restoration of engineering support systems and engineering support networks or their elements , as well as replacement of individual elements of load-bearing building structures with similar or other elements that improve the performance of such structures and (or) restoration of these elements.
The definition of overhaul of linear objects can be found in article 14_3 of the Civil Code.
What does the assignment of works to one type or another affect?
The main feature of the reconstruction work is the need to develop a complete set of design documentation, which includes all the mandatory sections of the RF Government Decree No. 87.
Also, in most cases, it will be necessary to carry out its examination.
In addition, you will have to obtain a building permit, in the event that structural elements or other characteristics of the reliability and safety of the facility are affected, as well as during the performance of work, the maximum permissible construction parameters are exceeded (part 17.4 of Article 51 of the Civil Code).
If you need to obtain a building permit, you also need to put the facility into operation after the completion of the work.
The procedure for preparing documentation for reconstruction is in many ways similar to the development of such documentation for new construction.- You will have to go through all the same stages. When carrying out a major overhaul, in accordance with clause 12_2 of article 48 of the Civil Code, it is necessary to develop only those sections of the project documentation that affect the work performed. In addition, in accordance with paragraph 2 of Article 51 of the Civil Code, in this case no building permit is required.
Also, the commissioning of the facility is not required upon completion of the work.
Note that the assignment of works to one type or another is in the competence of the owner of the facility or the person responsible for its operation. This also affects the accounting of the said person, but this is a completely different topic and will not be covered here.
Carrying out reconstruction works without a building permit or under the guise of major repairs is punishable by law. In accordance with part 1 of Article 95 of the Code of Administrative Offenses, for these actions, legal entities are fined from 500 thousand to 1 million rubles or administrative suspension of activities for up to 90 days.
Signs characterizing the reconstruction of a capital construction object
To begin with, let us note that at least one feature, indicated in the definition of the concept of "reconstruction", is sufficient to classify works as this type.
For example, the following types of work will be classified as reconstruction:
- 1) Changing the number of storeys of the building
This implies a change in the number of floors. It should be borne in mind that not all parts of a building are floors, for example, an attic (as opposed to an attic) is not a floor. Accordingly, when equipping an attic in the attic space, the number of floors will change and become 1 more. At the same time, as a general rule, a building permit will not be required (provided that the roof configuration is preserved). If the roof is also undergoing reconstruction and its angle of inclination changes at least slightly, then the building volume will increase or decrease, which is also a sign of reconstruction. - 2) Change in construction volume
In this case, a building permit is required, since part of the supporting structures is modified and the structural reliability changes. - 3) Replacement and (or) restoration of load-bearing building structures, excluding restoration / replacement of their individual elements with similar or improved ones
If at least one structural element remains during the demolition of the object, then all subsequent work will refer not to new construction, but to reconstruction, since part of the object is preserved. What designs and in what volume is completely irrelevant. Even if you completely demolish the building and erect a new one with the same characteristics, it will still be considered a reconstruction. And only in the case of the complete demolition of the old object and the construction of a new one, different from the one that existed in this place before, can the work be considered as a new construction.
The line between renovation and overhaul
According to the definitions of these concepts, the difference lies in the number of replaced structural elements.
Overhaul - replacement of part of the supporting structures or their individual elements. De jure, with the replacement of 99% of the beams, we can say that this type of work is a major overhaul. Thus, you do not need to develop a complete set of design documentation for the RF Government Decree No. 87, obtain a construction permit and commission the facility.
Briefly about the reconstruction and overhaul of linear facilities
The criteria that determine the line between reconstruction and overhaul of linear facilities are: changes in the class, category, originally established performance indicators of the facility, changes in the boundaries of the right-of-way or security zones.
In this article, we will not consider in detail the nuances of reconstruction and overhaul of linear objects and will restrict ourselves to giving one classic example: if you are going to build any object next to a road (gas station, car wash, etc.), then you will have to make entrances from it and ramps that are more likely to affect throughput. It is also possible that the right-of-way will change. Therefore, sometimes, formally and legally, during the construction of such facilities, it is necessary to reconstruct a linear facility.
