Very often, when planning to purchase a land plot in a gardening partnership, buyers are faced with the problem of the presence of any encumbrances on this plot. Fearing to acquire a number of problems along with the site, they simply refuse to buy. Let's determine whether the encumbrances are so terrible.
The encumbrance of a land plot is a restriction of the owner in his right to use and dispose of the land belonging to him. It may suggest the following:
restriction in the possibility of use (for example, a ban on placing industrial facilities in security zones);
the obligation to provide land for limited use to other people or organizations (easement);
restriction in the right of ownership and disposal (mortgage, etc.).
In horticultural partnerships, the most common encumbrance is the Development Regulatory Zone. What does it mean?
Let us turn for an explanation to the Federal Law of 15.04.1998 N 66-FZ (as amended on 03.07.2016) "On horticultural, vegetable gardening and summer cottage non-profit associations of citizens." Specifically, Art. 33 and Art. 34:
Article 33. Standards for the organization and development of the territory of a horticultural, vegetable gardening or dacha non-profit association.
The norms for the organization and development of the territory of a horticultural, vegetable gardening or suburban non-profit association are established by the executive authorities of the constituent entities of the Russian Federation in the manner established by urban planning legislation, taking into account their natural, socio-demographic, national and other characteristics. The basis for this is the basic standards for the organization and development of the territory of such associations, established by federal executive bodies and necessary to comply with environmental, land legislation, legislation on urban planning, sanitary and epidemiological welfare of the population, and fire safety.
The main standards for the organization and development of the territory of a horticultural, vegetable gardening or dacha non-profit association in accordance with urban planning legislation are:
- the number and size of access and internal roads;
- minimum distances between buildings, structures, structures and boundaries of land plots;
- type of water supply sources;
- technical characteristics of the engineering support of the territory of such an association;
- list of required fire-prevention structures;
- list of measures for environmental protection.
Depending on the specific conditions, other standards for the organization and development of the territory of a horticultural, vegetable gardening or dacha non-profit association may additionally be applied.
Article 34. The procedure for the construction of objects for individual (family) and general use in a horticultural, vegetable gardening or dacha non-profit association.
The construction of buildings and structures in a horticultural, horticultural or suburban non-profit association is carried out in accordance with the project for the organization and development of its territory.
Control over compliance with the requirements for the construction of buildings and structures in a horticultural, vegetable gardening or dacha non-profit association is carried out by the board of such an association, as well as by inspectors of state bodies exercising control over compliance with legislation, in the manner of author's supervision, the organization that developed the project for the organization and development of the territory of such an association, bodies local government.
The type of materials and structures used in the construction of buildings, structures and engineering infrastructure facilities is determined by the horticultural, vegetable gardening or dacha non-profit association and its members independently in accordance with the project for the organization and development of the territory of such an association.
The erection by citizens on garden, vegetable garden or summer cottage land plots of buildings and structures exceeding the dimensions established by the project for the organization and development of the territory of a horticultural, vegetable gardening or dacha non-profit association for these buildings and structures, is allowed after approval by the local government body of projects for the construction of these buildings and structures in accordance with the procedure established by urban planning legislation.
Violation of the requirements of the project for the organization and development of the territory of a horticultural, vegetable gardening or dacha non-profit association is the basis for bringing such an association, as well as its members who have committed a violation, to responsibility in accordance with this Federal Law and other federal laws.
So, according to Art. 33 and Art. 34 ФЗ - №66 dated 04.15.1998 The development regulation zone determines the maximum allowable height of buildings located on the land plot, the distance between buildings, etc. This zone limits the owner only in choosing the size of the house that he plans to build on his site, its location, and technical characteristics. But it does not affect the ownership in any way, does not limit the size of the plot. The presence of such a zone indicates that SNiPs exist in this gardening partnership, and, therefore, all buildings and structures on land plots must be built in compliance with town planning rules and the Law.
Zone of regulation of development and economic activity
The proposed zone of regulation of development and economic activity is subdivided into four sections - sections 1, 2, 3, 4, - with established modes of land use R-1, R-2, R-3, R-4 and the corresponding town planning regulations within the boundaries of the sections of this zones.
3.1. Description of the border of the zone of regulation of development and economic activity.
The zone of regulation of development and economic activity with the regime of land use P-1 includes one plot - plot 1, - located to the south-west, west and north of the territory of the monument, including a local passage, road sections - st. Arzhakova and st. Kaliningrad, located in the zone of compositional influence of the considered object of cultural heritage.
The area of the territory of the zone of regulation of development and economic activity with the regime of land use P-2 is: plot 2 - about 1.19 hectares.
The zone of regulation of development and economic activity with the regime of land use P-3 includes one plot - plot 3, located to the south-west and west of the territory of the monument and plot 1, stretching along the street. Ordzhonikidze, local passage, st. Arzhakova and st. Kaliningrad, located in the zone of compositional influence of the considered object of cultural heritage.
The following land plots are located within the boundaries of the site of the 4 zones of regulation of development and economic activity, registered in the Unified State Register of Rights to Real Estate and Transactions with it: land plot K No. 50: 45: 40822: 21, partially - land plots K No. 50:45 : 40822: 182 and K # 50: 45: 40822: 159 (occupied by garages of GSK "G elios").
The area of the territory of the zone of regulation of development and economic activity with the regime of land use P-4 is: plot 4 - about 1.23 hectares.
The mode of land use within the boundaries of the zone of regulation of development and economic activity:
For all sections of the zone of regulation of development and economic activity, it is prohibited:
construction of buildings and structures for industrial and communal storage purposes, placement of facilities that create cargo flows, pollute air and water basins, fire hazardous, explosive;
construction of objects with active silhouette completion (in the form of towers, spiers), dissonant volumetric-spatial and color scheme, facade decor;
economic activity leading to a significant change in the terrain (cutting, filling more than 0.5 m) without justification, causing pollution of soils, surface runoff and groundwater, violation of the existing characteristic hydrogeological conditions (change in the level of groundwater);
re-routing of historical access roads to A.N. Craft "Kostino", early. XX century;
the organization of unequipped places for garbage collection, the placement of sites with garbage containers in the zones of the main species disclosures on the territory of the monument;
making fires;
laying of ground engineering communications, placement of telecommunication towers, antenna masts, boiler pipes, advertising steles and other engineering structures of significant height;
allowed:
economic activity without prejudice to the safety of the A.N. Craft "Kostino", early. XX century, without distorting valuable panoramas, including the monument;
major repairs, reconstruction of buildings and structures, construction of residential and public buildings with infrastructure facilities, with the exception of special requirements for sections 1, 4 (the limiting parameters of construction for individual sections are determined by town planning regulations);
fencing of individual sites, placement of engineering infrastructure objects (TP, central heating station) in the depths of the building sites;
repair, reconstruction of road surface of roads, local passages, pedestrian paths, placement of parking lots along roads and local passages;
improvement and landscaping of the territory, placement of small architectural forms (benches, ballot boxes, lanterns), reconstruction and formation felling, sanitary felling of green spaces, planting of traditional tree species along the main entrances to the A.N. Craft "Kostino", early. XX century;
laying, repair, reconstruction of engineering communications, overhead and underground communication lines and power transmission lines;
carrying out any excavation work with the obligatory supervision of an archaeologist, with the exception of special requirements for site 2.
construction of new capital construction facilities;
reconstruction (expansion, superstructure) of the administrative building of TRV Corporation;
allowed:
reconstruction of individual elements of the building of the Church of the Nativity of the Blessed Virgin Mary 2005 (side extensions, outlets) in the existing height parameters;
repair, reconstruction of roads (Kaliningradskaya St., Arzhakova St.), local passage without widening towards the territory of the monument;
placement of public transport stops along the street. Kaliningrad.

use of the territory of the monument (park) as an adjoining territory of residential buildings;

carrying out any excavation work without advanced archaeological research;
allowed:
the solution of the functional planning organization of the territory and the placement of the projected volumes on the site of the demolished residential buildings in conjunction with the historical planning structure of the A.N. Craft "Kostino", early. XX century, with the preservation of the modern access road (Ilyicha st.) And on the basis of a project agreed with the authorities for the protection of cultural heritage objects;
in case of demolition of residential building No. 32 on the street. Dzerzhinsky, upon discovering the foundations of lost historical buildings (the Church of the Nativity of the Blessed Virgin Mary in 1691, the bell tower in 1863), the exclusion of this place from the construction zone with a breakdown of the memorial square and the installation of a memorial sign or a chapel.

Urban planning regulations within the zone of regulation of development and economic activity:
For plot 1 with the regime of land use R-1, it is allowed:
fencing of individual areas of the territory using forged, cast and similar "transparent" metal fences with height parameters up to 1 m;
improvement of the territory with the device of ordinary plantings of traditional tree species (linden, maple, birch, poplar) along the local passage, st. Arzhakova, st. Kaliningrad;
the use of "rocker" landings with a width of at least 5 m, ensuring the neutralization of the influence of the adjacent modern buildings.
For plot 2 with the regime of land use R-2, it is allowed:
new construction of residential and public buildings in the style of constructivism with the height parameters of the main volume up to 18 m (no more than six floors), with the maximum permissible height parameters of separately protruding structural elements (protrusions, extensions, etc.) up to 24 m, counting from the level land to the top of the building, with a decrease in the height parameters of possible construction near the intersection of st. Kaliningradskaya and st. Dzerzhinsky up to 15 m;
architectural solution of facades of buildings and structures using decorative elements, proportions of window openings, type of decoration in the style of early constructivism, similar to the buildings of the former Bolshevsk labor commune;
device along the street. Dzerzhinsky, no more than three parking lots with a capacity of no more than 20 parking spaces each;
improvement of the territory with the device of ordinary plantings of traditional tree species (linden, maple, birch, poplar) along the street. Dzerzhinsky with the aim of forming a green building facade, neutral in relation to the monument;
the use of "rocker" landings with a width of at least 5 m, ensuring the neutralization of the influence of engineering infrastructure objects.
For plot 3 with the regime of land use R-3, it is allowed:
reconstruction of buildings and structures in the existing parameters;
new construction of residential and non-residential buildings and structures, objects of cultural and domestic, commercial, office and business purposes with height parameters up to 15 m, counting from ground level to the upper elevation of the building, including all structural and decorative elements, with an increase in the height parameters of possible construction near the southern border of the site up to 30 m;
For plot 4 with the regime of land use R-4, it is allowed:
stage-by-stage reorganization of the territory in accordance with the town planning documentation, approved in accordance with the established procedure;
new construction of residential and public buildings (cultural, domestic, retail, office and business purposes, sports, recreation, health care) with maximum permissible height parameters up to 30 m, counting from ground level to the upper elevation of the building, including all structural and decorative elements ;
finishing of facades of neutral colors and textures, with the exception of sharply dominant elements;
fencing of individual areas of the territory using forged, cast and similar "transparent" metal fences with height parameters up to 1.5 m;
organization of approaches to the projected residential areas from existing roads and local driveways;
improvement of the territory with the arrangement of ordinary plantings of traditional tree species (linden, maple, birch, poplar) along the perimeter of the quarters in order to form a green building facade, neutral in relation to the monument;
creation of buffer green zones with a width of at least 10 m, ensuring the neutralization of the influence of modern buildings.
Protected natural landscape zone
The protected natural landscape zone is established in order to preserve valuable elements of the historical landscape, the compositional connection of the considered cultural heritage object with the natural environment, the integrity of the historical urban planning and spatial-type environment in the zone of compositional influence of the cultural heritage object in the context of the rapidly changing urban planning situation in the modern developing city of Korolev, Moscow Region.
Description of the boundary of the protected natural landscape zone.
The zone of the protected natural landscape is located to the north of the territory of the monument and section 1 of the zone of regulation of development and economic activity; includes the entire southern part of the Kostino DiKTs Park - up to the drainage ditch crossing the park from west to east.
Park DiKTs "Kostino", organized on the site of a previously existing mixed forest and reproducing the historical landscape, is located in the zone of compositional influence of the cultural heritage site of regional significance A.N. Craft "Kostino", early. XX century.
Within the boundaries of the protected natural landscape zone, there are no land plots registered in the Unified State Register of Rights to Real Estate and Transactions with It.
The zone of the protected natural landscape, see drawing No. 1 of this project "Map (diagram) of the boundaries of the protected zones" on a scale of 1: 2000, indicated by numbers: 10, 21, 22, 11, and graphically.
The border of the territory of the protected natural landscape zone passes: from point 10 - located near the intersection of the northern border
road right-of-way - st. Kaliningrad and eastern border of the right-of-way of the road - st. Arzhakova, on the southwestern corner of the territory of the park DiKTs "Kostino", at a distance of 60 m north of the main entrance to the Church of the Nativity of the Blessed Virgin Mary;
10 - 21 - to the north-east 128 m along the footpath along the street. Arzhakova;
22 - to the southeast-east, southeast, southeast-east, in total - 265 m, along the territory of the Kostino diKTs park, along the drainage ditch;
11 - to the south 78 m along the pedestrian path along the street. Dzerzhinsky;
11 - 10 - to the north-west-west 262 m along the northern border of the right-of-way - st. Kaliningradskaya, along the southern border of the Kostino DiKTs park, to the starting point.
The area of the protected natural landscape zone is about 2.53 hectares.
Land use regime within the boundaries of the protected natural landscape zone:
On the territory of the protected natural landscape zone, it is prohibited:
construction of capital buildings and structures;
economic activity that violates the character and appearance of the historical natural environment of the A.N. Craft "Kostino", early. XX century;
clear felling of green spaces, damage to the species composition, destruction of old-growth trees of valuable species, valuable soil-protective vegetation;
significant change in the terrain (cutting, filling more than 0.5 m) without justification;
pollution of soils, surface runoff and groundwater, violation of the existing characteristic hydrogeological conditions (change in the level of groundwater);
organization of unequipped places for waste collection;
making fires;
erection of reinforced concrete fences, fences made of profiled metal and similar "blank" fences;
laying of high-speed highways and roads, organization of parking lots;
laying of ground engineering communications, placement of telecommunication towers, antenna masts and other engineering structures of significant height;
allowed:
economic activities aimed at preserving and restoring (regenerating) the characteristic natural environment of the A.N. Craft "Kostino", early. XX century;
preservation and further formation of the recreational character of the territory with adaptation for modern use;
construction of non-capital facilities for the improvement and maintenance of the recreational area (sheds for the rental of inventory: sun loungers, bicycles, roller skates), placement of small architectural forms (gazebos, benches, urns, lanterns, decorative and drinking fountains), adapted to the historical environment inherent in the monument, with altitude parameters up to 4 m;
organization of walking and cycling routes, arrangement of recreational areas (playgrounds
recreation), equipped with a modern landscape
lighting;
use of finishing materials for non-capital objects
improvement and maintenance of the recreational area, small architectural forms, road surfaces, paving elements of neutral colors and textures;
fencing of the territory around the perimeter using forged, cast and similar "transparent" metal fences with height parameters up to 2 m;
carrying out works on landscaping and landscaping of the territory, taking into account the preservation of valuable green spaces;
carrying out medical and recreational measures for sick and weakened old-growth trees of valuable species, thinning for the purpose of reconstruction of green areas, with subsequent compensation of green spaces;
repair of the road surface of walking pedestrian and bicycle paths;
laying of paths, underground utilities, taking into account the preservation of valuable green spaces.
In accordance with the Town Planning Code (Article 36. Town Planning Regulations, clause 4), the town planning regulations do not apply to land plots within the boundaries of common areas (in this case, within the boundaries of the Kostino DiKTs Park, the southern part of which is included in the protected natural landscape).
The mode of using these territories provides for a more active and versatile reconstruction of the environment, individual buildings and structures. If only the regeneration of the environment is allowed in the protected zones of monuments; conservation, restoration and reconstruction of monuments, then in the regulated development zone, more active methods of urban planning, volumetric and functional reconstruction can be used, namely, renewal, transformation and restructuring of the environment, partial and complete modernization of historical and modern buildings, new construction.
The degree of reconstructive intervention is determined as follows:
- the value of the object(an architectural monument, a valuable building, a low-value building, a disharmonious building);
- safety of the object and environment(4 categories of preservation: preserved as much as possible; preserved with minor changes in the space-planning solution; preserved with significant changes in the space-planning solution; not preserved (it is in a destroyed state));
- modern requirements to the object and environment;
- accommodation object in relation to the protected area of the monument;
When designing in a regulated development zone, it is necessary to take into account the requirements for the use of development regulation zones.
CONSERVED:
Valuable historical planning and building, landscaping and landscaping, expressive landscape elements;
The importance of monuments in the architectural and spatial organization of the environment is preserved and restored. What does it mean? This means that the basic principle of subordination is preserved. The monument is dominant, all other buildings are its background, subordinate to it; those. planning, architectural and functional, everything should be subordinate to the monument or supplement it;
The best view conditions for monuments are provided;
The scale of all buildings and structures is ensured to the historical environment.
ACCEPTED:
Supplementing the existing planning structure with new streets, driveways and entrances; (new streets are formed after comparing historical plans and modern planning structure by overlapping them);
Expansion of the boundaries of the red lines of historical streets, while their direction is sure to be preserved;
Formation of new quarters is allowed; (usually on undeveloped territory or vacated warehouse or other disharmonious outbuildings; the form quarters are determined after comparing historical plans and modern planning structure by superimposing them on each other; the size new quarters should be less than the territory of the monument, the size of buildings in terms of spot and volume - less than the size of the monument);
Rather active construction of new buildings is allowed, but, at the same time, they are clearly regulated by:
1) placement;
2) methods of planning organization (as a rule, quarterly, perimeter with an inner courtyard;
3) height (in each separate city - in different ways, depending on the height of the monuments and the number of storeys of historical buildings; in Kiev - 27m);
4) the length of the facades (no more than the traditional for a given city the length of the facade of historical buildings; small cities - 3-4 windows; multi-section - are prohibited, or the sections must differ from each other in height and plasticity);
5) scale (according to the prevailing in a given historical environment for ordinary, accent and dominant buildings);
6) the nature of the division of the facades, vertical and horizontal (close to the historical);
7) plastic and color solutions (there may be new forms, new materials, but similar in color and plastic in a given environment);
8) functional use (the new function should not contradict the historical ones, should complement and develop them; should not cause the destruction of the ensemble).
In general, the correct functional organization is a very important point in the mode of using the development zone. It is very important which function to remove, as disharmonious, and which to add in order to actively develop the environment, but also not to harm this activity.
So from the area of regulation of development it is necessary to REMOVE
disharmonious industrial and warehouse enterprises. There are three options:
1. Renovation (renewal) of an industrial enterprise. The enterprise is being modernized, redesigned, the territory is reduced, only harmless production remains, which does not require large storage facilities and transport load.
2. Adaptation to a new function with a change in appearance - complete modernization.
3. Demolition, on site - recreational area.
If for some reason it is impossible to demolish the disharmonious buildings or complete modernization does not completely solve the problem (for example, lowering the height), they make the so-called "green curtain", which visually separates the historical buildings. Exactly the same technique is used if it is necessary to separate a transit highway from a historical building and this highway cannot be moved in any way.
Concerning empty, abandoned territories... There are many of them, especially in small towns. Empty territories, after studying and drawing up a historical and urban planning justification, can also either be built up with new buildings with a missing function, or given over for recreation.
In the development regulation zone it is FORBIDDEN:
Placement of new industrial, transport and warehouse enterprises that create large cargo flows; (this requires the expansion of roads, the construction of new interchanges that can disrupt the intimacy of the historical environment);
Construction of new highways, esplanades, bridges, junctions, which can also spoil the traditional character of the environment. What are they doing in Europe? They launch transport underground, make any junctions with a combination of several modes of transport. Only the entrances remain above ground, which are solved in the form of separate elements (small architectural forms) in squares, streets, or are tied to some ordinary building. You enter the building, go down the escalator and find yourself at the station. Example, Brussels, Munich
Protected landscape zones. Their territory can be used:
1) for recreation with carrying out improvement works;
2) for traditional economic activities that do not disturb the landscape and do not require the construction of capital structures on this territory; (typical for small towns).
On the territory of the protected landscape zone it is ALLOWED:
Strengthening of the coast, renovation and its modern adaptation (for example, for a promenade embankment);
Strengthening of slopes, planting of greenery, improvement;
Existing individual buildings may be retained if they do not disturb the landscape;
New construction of individual residential houses in that part of the zone where individual development already exists, if new houses are not placed on the upper elevations of the relief, and their height does not exceed 7m (2 floors).
All industrial and warehouse buildings should be REMOVED.
FORBIDDEN:
Construction of new buildings and structures of medium storey and higher;
Construction of roads, laying of engineering networks, overhead power lines, any other construction and earthwork not related to the protection, restoration and reconstruction of the protected landscape.
Protection zones of the archaeological cultural layer. The mode of use is as follows:
All construction and earthworks, planting of trees are carried out with the permission of the state authorities for the protection of cultural heritage and under the supervision of an archaeologist;
Prior to the commencement of large-scale construction or excavation work on the sites, studies should be carried out in accordance with construction placement plans;
Upon completion of the research, the sites on which the remains of old buildings and structures will be found are subject to protection as immovable monuments of cultural heritage. You cannot build on this place. If no remnants of buildings are found on the site, after a complete study, the site is removed from the zone of the archaeological cultural layer by decision of the state authorities for the protection of cultural heritage.

The protected zone of a monument consists of many factors where not only the height of the surrounding buildings, the presence of other monuments in the neighborhood, the importance of the protected object, but even the requirements for environmental conditions - the influence of transport, industry, etc., intersect. This topic is quite voluminous and difficult. The design conditions are not yet clear to determine the protected zone of the monument and it is rather difficult to advise on specific dimensions.

The boundaries of the protection zones of the cultural heritage object (with the exception of the boundaries of the protection zones of especially valuable cultural heritage objects of the peoples of the Russian Federation and cultural heritage objects included in the World Heritage List), modes of land use and town planning regulations within the boundaries of these zones are approved on the basis of the draft zones for the protection of the cultural heritage object
in relation to objects of cultural heritage of federal significance - by the state authority of the constituent entity of the Russian Federation in agreement with the federal body for the protection of cultural heritage objects, and in relation to cultural heritage objects of regional significance and cultural heritage objects of local (municipal) significance - in the manner established by the laws of the constituent entities of the Russian Federation.

2.2. Building regulation zones
and economic activity (ZRZ)
Zones of regulation of development and economic activity are established in territories associated with cultural heritage objects by a system of spatial relationships that have preserved the components of the historical urban planning environment, or formed by new buildings, but included in the system of valuable urban panoramas and views, in order to preserve the historically established characteristics of the urban planning background of cultural objects. heritage, as well as the compositional development of the urban ensemble using heritage sites as city-forming factors.
For this purpose, on the territory of zones of regulation of development and economic activity, general regulations are established with special requirements for subzones and sections of subzones.
2.2.1. General regulations within regulation zones

Within the boundaries of the zones of regulation of development and economic activity, it is not allowed:
construction and placement of enterprises creating increased cargo flows, explosive and potentially having a negative impact on cultural heritage sites;
placement of high-rise dominants, introducing dissonance into the volumetric-spatial composition of urban panoramas and views, reducing the compositional role of historical town-planning dominants, worsening the viewing conditions and characteristics of the urban background of cultural heritage sites and natural monuments;
demolition of historical buildings belonging to the category of historical buildings, with the exception of the dismantling of dilapidated and emergency buildings, in accordance with the established procedure and the conclusion of the historical and cultural expertise.
Within the boundaries of the zones of regulation of development and economic activity, it is allowed:
construction of new, reconstruction of existing buildings and structures, road network, landscaping, landscaping in accordance with the regulations and special requirements;
demolition of emergency disharmonious objects;
placement on separate sites, in accordance with the Rules for Land Use and Development of a Part of the City of Bryansk and this Regulation, high-rise dominants and accents that positively form the urban planning environment.
Within the boundaries of the zones of regulation of development and economic activity, it is recommended:
visual neutralization of disharmonious objects with the help of green buffer zones, a change in their volumetric-spatial solution, a change in the architectural solution of facades, demolition as they are depreciated;
removal of industrial enterprises, construction on their territories of facilities that meet the requirements of the regulations of the Rules for land use and development of part of the territory of the city of Bryansk;
development, in agreement with the state body for the protection of cultural heritage sites, integrated planning and land surveying projects, as well as projects for the development of territories subject to urban planning transformation (including converted industrial territories). Such projects should include sections of special historical-cultural and visual-landscape justifications with detailed town-planning regulations for the protection of cultural heritage objects.
Taking into account the provisions of this regulation, urban planning regulations for the types and parameters of permitted use of real estate provided for these sites by the Rules for Land Use and Development of Part of the Territory of Bryansk are in force in the areas of the zone of regulation of development and economic activity.
According to the general directions of urban development (development within the framework of existing morphotypes of development, limited reconstruction, transformation), the territory of the zone of regulation of development and economic activity is subdivided into 5 subzones, in which, in turn, 8 sections of zones are distinguished, differing in the parameters of permissible construction changes in real estate objects.
2.2.4. Special requirements in subzone ZRZ.3
Within the boundaries of subzone ZRZ.3 it is allowed:
urban development of territories with a change in the existing morphotypes of buildings and an excess of the prevailing height of the existing buildings in a given zone;
reconstruction of buildings and structures with a possible superstructure (with the exception of buildings belonging to the category of historical buildings);
creation of new high-rise accents;
the placement of new high-rise dominants (buildings and structures exceeding the silhouette-forming height of a given zone by more than 1/4) refers to the conditionally permitted uses of land plots in the zone. The issuance of a permit for the placement of new high-rise landmarks is carried out in the manner prescribed by the Rules for Land Use and Development of Part of the Territory of the City of Bryansk for conditionally permitted uses of real estate. At the same time, a legal entity or individual interested in obtaining such a permit is obliged to submit to the commission for the preparation of the draft Rules for land use and development of the territory of the city of Bryansk materials of urban planning and compositional justification for the placement of a high-rise dominant with visual landscape analysis (drawing a 3D model of the projected object into photo panoramas from control viewpoints, sweeps, perspectives, master plan).
