As everyone knows, jokes with the tax office are bad. Therefore, the calculation and payment of taxes are treated with particular care at each enterprise. Individual entrepreneurs (hereinafter referred to as individual entrepreneurs) are no exception.
Tax law is quite complex; it contains a huge number of rules that are closely interrelated. It is not easy to understand them, so you can find yourself in tax evasion, sincerely believing that you have paid all the necessary fees. Correct and timely payment of taxes is the key to the normal and trouble-free functioning of any company. To avoid the accrual of possible penalties, you need to carefully monitor the occurrence of tax debts.
We will tell you how to do this, while saving valuable time, using the capabilities of the Internet and SMS, in our article.
What taxes can you use to find out what you owe?
Knowing your TIN, you can find out all the necessary information regarding taxes such as property tax, transport and land taxes and personal income tax.
According to statistics, the most requests are for transport tax; various misunderstandings and errors are associated with it - sometimes you receive a notification about a debt on a sold car. Difficulties also arise with land tax, this is due to changes in the value of a land plot or the abolition of any benefits. The cost is determined by local governments. Therefore, it is important to control the tax payment process and monitor your debts.
On special Internet services that provide access to tax data, you can not only find out the amount of your debt, but also create a payment order and even pay online. We will talk about these services further.
True, online payment is possible only through those banks that have an agreement with the Federal Tax Service.
Individuals via the Internet
The easiest, cheapest and fastest way to check your debt is online via the Internet, because now it is carried out in almost every home.
To do this, you need to go to the website of the Federal Tax Service of the Russian Federation. Here we select the section dedicated to individuals and go to your personal account. Login to your personal account is available if you know your TIN, which is also your login, as well as your password. Click on the heading “Find out your debt”, a message will appear in the window stating that you agree to the transfer of personal information. Don't be alarmed, this is just a formality.
Today, all citizens of the Russian Federation have access to this resource. This does not apply to foreign citizens and stateless persons.
However, there are several nuances. Let's look at them in order:
- First, you must know your TIN. If you don’t know him, you can also find him out on this site. There is a special section - “Find out TIN”; by entering your passport data there, you will receive your number.
- The password is a little more complicated; you can only find it out in person by contacting the tax office. The password and login will be indicated in the registration card, which can be obtained from any tax office of the Russian Federation, except specialized ones. Apart from a passport and TIN, no other documents are required.
It would seem, why come to the tax office and wait in line for a password if it’s easier to get it via the Internet. This procedure is designed to protect the taxpayer’s personal data. After receiving the initial password, you must change it to another one at your discretion. The main requirement is that no one should know your password except you. - If you lose your password and login, you should contact any tax office, they will give you new data.
There is another way to log into your personal account - universal electronic card or electronic signature. They are issued by a specialized authority on various media and require special software. Without one or another registration method, it will not be possible to find out any data.
Using this site, individuals will be able to find out the following information:
- data on the person’s property and vehicles;
- the amount of tax payments, both accrued and paid;
- tax debt to the budget.
In your personal account, functions such as filling out in real time, tracking a desk audit of this declaration, and seeking advice from the tax authorities are also available. It will also be possible to create a payment document and pay for it immediately.
More information about this process can be seen in this video:
Legal entities via the Internet
Just like individuals, legal entities have their own personal TIN. On the website you need to go to the “Legal Entities” section and log into your personal account by entering your username (TIN) and password.
Using this site, legal entities will be able to find out:
- the amount of your debt to the budget;
- accrued and paid amounts of payments;
- overpaid tax amounts (amount), such amounts are offset or returned;
- forced debt collection measures, etc.
They can also perform actions such as:
- sending a request and receiving the appropriate certificate about the status of tax calculations and statements of reconciliation of calculations;
- sending a request for a certificate stating that tax obligations have been fulfilled;
- communicate with representatives of tax authorities in case of questions or errors in information;
- initiate reconciliations of calculations.
Directly to the tax office
If you do not have access to the Internet or cannot log into your personal account, then you need to go directly to the tax office to find out the amount of debt. Sometimes this is also necessary for reconciliation, for example, if errors are detected in the information posted on the site. Despite all the convenience of the Internet service, experts recommend sometimes showing up at the tax office and conducting reconciliation on the spot.
You can write a statement and they will provide you with information about the debt. True, you will have to stand in line. If you have access to the site, you can contact the tax office with the printed data and verify the available data.
Another point that is worth paying attention to is that in organizations the director or chief accountant has the right to demand a reconciliation report or an extract. A power of attorney must be issued for other persons.
You need to decide in advance what you need: a personal account statement or a reconciliation report. The reconciliation act has full legal force, the extract does not. The extract is more internal information. For government agencies or court hearings, only an act is suitable.
Via SMS
Another option is to find out your debt via SMS. Please note that This service is paid, the amount of payment is set by the mobile operator. Usually, the cost is low. You can find out the number to which the SMS with TIN is sent from the local tax office. In the response message you will see the total amount owed.
This is a convenient method, but it is limited only by the total debt; you will not be able to find out which tax you owe. More detailed information can only be found on the website or at the tax office itself.
Consequences of tax arrears for individual entrepreneurs and organizations
If you still haven’t kept track of your taxes and you have an outstanding debt, then tax legislation provides for penalties. Non-payment or partial payment of taxes entails a fine in the following amount:
- 20% of the unpaid amount in case of unintentional action. For example, errors or short-term violation of the established payment deadline;
- 40% of the unpaid amount in case of intentional acts.
First, the tax office notifies the individual entrepreneur or organization about the debt. If it is not paid on time, then in addition to the tax itself, you will also have to pay a fine. If the taxpayer does not pay it voluntarily, compulsory collection measures. For example, seizing a bank account and writing off from it those funds that should have been paid to the budget. Or seizure of property, a ban on individual entrepreneurs traveling abroad of the Russian Federation.
Therefore, the faster the debt is repaid, the smaller its size will be - after all penalty is charged for each day. Legal entities are also subject to criminal liability for debt:
- in a large amount - more than 2 million rubles for 3 years in a row or more than 6 million rubles, the share of unpaid taxes exceeds 10% of the tax amounts payable;
- on an especially large scale - more than 10 million rubles for 3 years in a row or more than 30 million rubles with a 20% share of unpaid taxes.
As for individuals, the amounts are slightly less:
- large size - over 600 thousand rubles for 3 years, unpaid share - 10% or 1.8 million rubles;
- especially large - over 3 million rubles over 3 years, unpaid share - 20% or more than 9 million rubles.
Thus, you have become familiar with how in various ways to obtain all the necessary information about tax debt, having a minimum of documents in your arsenal. If you detect the debt in time, you will avoid sanctions and extra cash costs. Monitor payment and calculation of taxes using the Internet, and you will not find yourself in an unpleasant situation.
Tax debts are a thing fraught with negative consequences for those who have them. Such consequences occur regardless of the type of taxpayer: individual, individual entrepreneur or legal entity. That is why every payer needs to keep control over the issue of tax arrears.
Reasons for having tax debts
One of the most important for every taxpayer is the obligation to pay taxes, insurance premiums and fees (subclause 1, clause 1, subclause 1, clause 3.4, clause 4, article 23 of the Tax Code of the Russian Federation). Of course, only if they are accrued legally.
Tax payments are calculated by:
- It is a legal entity, and because of this, it usually has an idea of its existing debts.
- Individual entrepreneur - only in relation to those payments that are due to his entrepreneurial activities. According to the terms of calculating property taxes, he is equal to an individual, and this frees him from the need to independently calculate taxes on property, land, and transport. Thus, an individual entrepreneur can independently monitor the presence of tax debts only by their types arising in connection with their main activities.
- Tax authority - in relation to property taxes paid by individuals and individual entrepreneurs. He is obliged to notify payers of the amount of calculated amounts within a certain time frame and in writing. Failure to receive such a document results in the taxpayer having an obligation to notify the Federal Tax Service about the presence of property subject to the corresponding tax (clause 2.1 of Article 23 of the Tax Code of the Russian Federation).
However, there are always likely circumstances due to which the idea of the real amount of the tax will be distorted. Basically, they will be in the nature of technical failures - errors in accounting data, failure to receive or loss of information about accruals or additional accruals made by the Federal Tax Service.
Consequences of non-payment of taxes
Failure to pay taxes on time not only leads to the accrual of penalties on the amount of the debt (clause 1 of Article 75 of the Tax Code of the Russian Federation), but can also serve as the basis for initiating a procedure for collecting or forcing payment of the debt by:
- writing off funds from the current account of a legal entity or individual entrepreneur by decision of the tax authority (Article 46 of the Tax Code of the Russian Federation);
- blocking current accounts of legal entities and individual entrepreneurs (Article 76 of the Tax Code of the Russian Federation);
- seizure of property of legal entities (Article 77 of the Tax Code of the Russian Federation);
- recovery at the expense of property, including property owned by individuals (Articles 47 and 48 of the Tax Code of the Russian Federation);
- going to court (clause 2 of article 45 of the Tax Code of the Russian Federation) with the subsequent involvement of the bailiff service in the collection procedure.
In the latter case, on the Federal Tax Service website, if the amount of debt exceeds 1 thousand rubles, the defaulting legal entity is included in the list of debtors, available for viewing by anyone who wants to receive such information.
In addition, you may be fined for failure to pay taxes.
That is, non-payment of taxes leads to quite serious consequences. That is why the question of periodically checking the existence of debts on them is always relevant.
How to find out the tax debts of individual entrepreneurs, legal entities and individuals?
How to find out the tax debts of an LLC, check for tax debts of an individual entrepreneur or find out the tax debt of an individual? There are several ways.
But in order to use it, you must have information about the TIN (taxpayer identification number). This number is unique and is assigned when the payer registers. Therefore, you need to check an LLC for tax debts or find out the tax debts of an individual entrepreneur using the TIN. Knowledge of this number is also necessary for an individual interested in his debts.
Informing tax payers about their debts is the responsibility of the tax authorities (subclause 10, clause 1, article 32 of the Tax Code of the Russian Federation) for a situation where a request (paper or electronic) is received from the payer to provide the relevant information. In this case, the Federal Tax Service can issue a certificate of one of two types:
- on the status of settlements - its two options (for legal entities and individual entrepreneurs and for individuals) were approved by order of the Federal Tax Service of Russia dated December 28, 2016 No. ММВ-7-17/722@;
- on the fulfillment of the obligation to make payments (approved by order of the Federal Tax Service of Russia dated January 20, 2017 No. ММВ-7-8/20@).
The specific amounts of debts available on the date the certificate is generated can only be seen in the certificate of the first type. The second document (about the fulfillment of an obligation) will contain only information about whether this obligation has been fulfilled or not.
However, the option of requesting a certificate of settlement status is good when the taxpayer needs an official document to submit to some authority. If we are only talking about finding out whether there are debts for any taxes and what their amounts are, then you can use other verification methods recommended by the Federal Tax Service:
- On the Federal Tax Service website (https://www.nalog.ru), where, by registering in your personal account, you can find out the tax debt of both legal entities, individual entrepreneurs and individuals. Here you can also check counterparties for tax debts of legal entities by TIN, OGRN or name, transferred for collection to the bailiff service. Registration in your personal account is possible using:
- login and password issued by the Federal Tax Service;
- qualified electronic signature;
- account for access to the State Services website.
- On the Gosuslugi website (www.gosuslugi.ru) you can check the tax debts of individual entrepreneurs using the TIN in the same manner as for an ordinary individual. Legal entities cannot obtain data on their debt here. To register on this site, an individual will have to go through an identity verification procedure. It is possible:
- through service centers;
- some online banks (Sberbank Online, Tinkoff, Post Bank Online).
If you find a tax arrears, you need to find out the reason why it arose. Depending on this, the procedure for further actions of the taxpayer differs. What needs to be done in each case is described in detail in the Ready-made solution from ConsultantPlus.
Verification of debts transferred for collection to the bailiff service can be carried out on the FSSP website (http://fssprus.ru/) using the last name and first name of the individual or individual entrepreneur’s TIN.
Results
Failure to pay taxes may be fraught for the taxpayer not only with additional expenses in the form of penalties, but also with forced collection of the unpaid amount, including at the expense of property. Therefore, the ability to quickly obtain up-to-date information about the presence of tax debts is of particular importance. Taxpayers of all types (legal entities, individual entrepreneurs, individuals) can find out about their debt on the Federal Tax Service website. For individual entrepreneurs and individuals, a similar service is also available on the State Services website.
Typically, ordinary people pay:
- Tax on the income of individuals (themselves, if we are talking about renting out an apartment, tutoring at home, winning the lottery or an expensive gift).
- Property tax (apartment, house, garage, outbuildings, etc.).
- Land tax.
- Transport tax (levied on owners of cars, motorcycles, scooters, yachts, snowmobiles, motor boats and other registered vehicles).
It's easy to get confused in all this. But if you did not receive a notification due to the fault of the mail or received it, but kept postponing payment, and then completely forgot about the Federal Tax Service, this is your problem. The taxpayer’s task is to independently learn about taxes and pay them on time.
Failure to complete this task has consequences. Here's what you're facing:
- Collection of arrears through the court. If the debt is more than 3,000 rubles, the tax authorities have the right to go to court. The punishment can be quite severe. At best, you will get off with a fine of 20 to 40% of the unpaid amount. But there is also criminal liability. For tax evasion, you can lose up to 500,000 rubles or be imprisoned for up to three years.
- Collection of taxes from property. If taxes, penalties, and fines remain unpaid after a court decision, the tax office can re-apply to the court and pay off the debt at the expense of the debtor’s property, including money lying in the bank.
- Inability to travel abroad. If your debt exceeds 10,000 rubles, there is a chance that you will not be allowed to leave Russia. By the way, the same thing will happen if you don’t pay for housing and communal services.
