On the appointment of a preferential pension to teachers
The pension reform has caused a lot of noise. Not everyone has yet managed to grasp the essence of the changes that largely affect educators. Despite the fact that teaching staff have preferential conditions for receiving a pension, there are many controversial points in the procedure for registering it. Who is entitled to a preferential pension? How is it charged? Can I get out early? What nuances need to be taken into account? Let's figure it out.

Today there is no such thing as a seniority pension for teaching staff. This category of workers operates in special working conditions. Therefore, a number of state privileges are provided for it. The state guarantees teachers the opportunity to go on a well-deserved rest earlier than most working citizens.
In view of the numerous changes, each teacher asks the question: what will be the preferential experience now?
Note that the preferential pension is similar to the old-age labor pension. However, the employee whose work activity falls under certain conditions has the right to receive it.
Previously, the pension for teachers was calculated taking into account the length of service. According to the law, it was possible to go on a retirement vacation if the work experience was at least 25 years.
With the introduction of insurance of pension contributions, mandatory for all citizens, pension accruals have ceased to be calculated taking into account the length of service. New calculation rules began to be used: the preferential length of service of employees is taken into account, and the right to early retirement remained with the teachers.
Normative base
To take into account all the nuances of the pension reform, it is necessary to understand what legislation regulates this activity.
For registration of a preferential pedagogical pension for 2017, the following legislative acts are relevant:
- Federal Law "On Insurance Pensions" (Art. 30−31);
- Resolution of the Government of the Russian Federation No. 665 dated July 16, 2014;
- Resolution of the Government of the Russian Federation No. 781 dated October 29, 2002.
Attention! Now, 25 years of experience includes those years that a person spent on their own education, but if the pedagogical activity was carried out by him before the start of his studies and after graduation. Also, if a person until 2016 worked in a pedagogical institution corresponding to the list of privileged categories, then all work performed will be included in the length of service.
Not all categories of teaching staff may be eligible for a preferential pension
The state has determined the range of positions of educators who have the following right:
- director;
- deputy heads involved in the implementation of the educational process;
- head of the educational department;
- Assistant Director for Regime;
- senior duty officer;
- duty officer;
- teacher;
- Senior Lecturer;
- kindergarten teachers of all levels;
- school teachers, teachers and methodologists with a combination of the position of an educator;
- industrial training master;
- specialists - organizers of extracurricular activities;
- teachers who are also psychologists;
- speech therapists, teachers acting as a speech therapist;
- teachers of music schools, physical education, social educators, teachers leading coaching activities;
- teachers working on additional educational programs;
- individual specialists.
It is important to note that a preferential pension will be awarded only if the teacher has worked for at least 25 years in a particular educational institution:
- primary, secondary schools, specialized lyceums and gymnasiums;
- general education schools for orphans, children with physical and mental disabilities, lagging behind in development;
- cadet corps;
- naval schools;
- orphanages;
- boarding schools for children under the age of majority;
- sanatorium-type schools;
- kindergartens and nurseries;
- educational centers for gifted children;
- correctional and special educational institutions of all types, including closed ones;
- institutions of primary and secondary vocational education, including schools, technical schools;
- specialty schools such as music or art;
- diagnostic centers;
- rehabilitation centers for recovering children after injuries and illnesses;
- institutions of additional education.
Attention! It is necessary to check whether your position is recorded correctly in the work book. Often, contradictions can lead to conflict situations with the employer, and sometimes to legal dispute.
Terms of appointment
In order to realize the opportunity to go on a well-deserved rest earlier than usual, the following conditions must be met:
- work experience of at least 25 years and the required pension coefficient;
- performing work throughout the full working day, for which insurance premiums were deducted. The payment of contributions also applies to hospital periods. Usually the minimum number of hours of work per year is 240, in secondary school - 360. A different number may be in primary and rural schools;
- the position of the teacher and his place of work must be entered in a special state register.
What is meant by the wording "full time work"?
It is necessary to understand that in order to retire ahead of schedule, a teacher must work a certain number of hours provided for in the full rate of salary payment.
Let's take a look at some of the categories of teaching staff.
At least 36 hours for a working week must work:
- psychology teachers;
- teachers involved in the physical and labor education of children;
- librarians and specialist methodologists.
At least 30 hours during the working week, educators of children's educational institutions.
About 25 hours and more teachers should work during the week teaching children with disabilities.
At least 20 working hours weekly should be worked out by speech therapists, defectologists who conduct their activities in school or preschool institutions.
For some teaching staff, an individual system of crediting the length of service is provided. It refers to:
- heads of orphanages and boarding schools;
- music teachers;
- primary school teachers who work in rural areas.
What is not included in the experience?
- vacation study period;
- unpaid leave;
- the period of caring for a newborn or a disabled person (exception: the length of service includes leave for caring for a child up to 3 years, which took place before October 6, 1992);
- absenteeism from work without good reason;
- temporary transfer to another job or part-time job.
Attention! If the teacher began his activity before September 1, 2000, then this period will be taken into account in full when assigning a preferential pension. The main condition is the presence of appropriate entries in the work book.
Registration procedure
To apply for a preferential pension, a pedagogical worker must contact the regional office of the Pension Fund of the Russian Federation (or at the place of registration) with the following list of documents:
- passport of a citizen of the Russian Federation;
- employment history;
- military ID (for men);
- certificate of registration of the birth of a child;
- SNILS;
- application for early benefits;
- certificates of income for the last year;
- clarifying help.
Documents for registration of a preferential pension can be submitted in person, through a representative, or use the electronic system. The term for consideration of the application is up to 10 days.
It should be noted that when assigning an early retirement pension to teachers, many questions arise regarding the confirmation of preferential length of service. Therefore, it is better to contact the territorial body of the FIU in advance.
Common mistakes
Often, employers are to blame for the fact that the FIU employees did not take into account a particular period of work (this can happen with disputable periods). This is due to the fact that the indicated names do not correspond to the official ones.
Attention! A teacher who continues to work in an educational organization may not use the right to receive pension payments early. However, the right to use them remains with him without fail.
