Teacher's pension in the light of changes in pension legislation
The pension train in 2015 went on new rails. There were enough changes for everyone: for civilians, and for the military, and for civil servants. The new order did not bypass the educators either. What changes have been made to teachers' pensions? How is the superannuation pension determined in 2015 and will it continue in the future? Below is a brief overview of the education pension reform.
Service pension?
Perhaps the main question that worries all teachers and teachers in connection with the latest changes is whether they will retain the right to early retirement in 2015?
Recall that until 2001, citizens engaged in pedagogical activities in children's educational institutions were assigned a seniority pension (based on the Law of the RSFSR No. No. 1397 dated 12/17/59). To receive a pension, a teacher, teacher, educator or other worker in the field of education had to have at least 25 years of experience in educational activities.
In 2001, in connection with the introduction of compulsory pension insurance, seniority pensions were actually abolished. They were replaced by preferential labor pensions, calculated according to the new rules, but still retaining the right for teachers to take a well-deserved rest earlier than expected.
And now, 14 years later, the main pension law of the country has undergone another wave of changes. Labor pensions have become insurance, and such concepts as insurance experience and pension points have entered our everyday life.
What does this mean for educators? Along with other citizens of the Russian Federation, educators are now dependent on the size of their pension contributions. The size of the pension no longer depends on the average wage. All that matters is the amount of annual pension contributions. The more the teacher deducts and the more he works, the more his pension will be.
Until any changes are made to the Federal Law No. 400 of December 29, 2013, teachers retain the right to a preferential seniority pension. The main condition for obtaining it in 2015 is still a special seniority. But that's not all.
According to the new rules, teachers will have to learn how to count years and coefficients, as well as tirelessly monitor compliance with the norm of working hours. In more detail, we will talk about the procedure for assigning early pension further.
Conditions for early retirement
In order for the teacher's retirement day to come faster, strict compliance with the requirements of subparagraph 19 of paragraph 1 of Article 30 of Federal Law No. 400 of 12/29/13 is required.
What are these requirements?
- The presence of 25 years of experience in children's education institutions and the minimum individual pension coefficient in the year of retirement (in 2015 - 6.6, in 2016 - 9, in 2017 - 11.4).
- Compliance of the position and place of work with the approved state lists (for details, see Decree No. 781 of October 29, 2002 for periods of work from 2001, Decree of the Government of the Russian Federation No. 1067 of September 22, 1999 for periods of work from 1999 to 2001, Resolution of the Council of Ministers of the RSFSR No. 463 dated 09/06/92 for the periods of work from 1992-1999, Resolution of the Council of Ministers of the USSR No. 1397 of 12/17/59 for the periods of work until 1992).
- The implementation of pedagogical activities on a full-time basis (Order of the Ministry of Education and Science No. 1601 of December 22, 2014).
Working hours
We recommend that future pensioners pay special attention to the last point: to offset the hours worked in the professional experience. Since 2015, in order to receive a superannuation pension, a teacher must work out a standard of working time corresponding to one full salary:
- 36 hours a week - university professors, psychologists, labor workers, physical education teachers, senior counselors, librarians, methodologists,
- 30 hours a week - senior educators in preschool;
- 25 - teachers, educators, educators working with disabled children;
- 24 hours a week - music teachers;
- 20 hours a week - speech therapists and defectologists in preschool educational institutions and schools;
- 18 hours a week - teachers in schools, teachers and teachers of additional education, teachers in sports schools and art schools, teachers of foreign languages in preschool educational institutions;
- 720 hours per year - teachers of secondary specialized educational institutions
For a number of education employees, there are special conditions for offsetting professional experience. Such employees include heads of educational institutions, orphanages, music teachers, directors of medical sanatoriums, teachers of primary classes in rural schools, etc.

Retirement procedure
In general, the procedure for granting an early pension is no different from the procedure for granting a regular pension. The best scenario is when a teacher, about six months before retirement, applies to the Pension Fund with a statement on the calculation of professional experience.
This time is usually enough to collect documents and confirm the required minimum length of service. Remember, early retirement cannot be granted before the teacher or educator has worked out the time necessary to assign a pension. If all the necessary documents are available, congratulations to the teacher on retirement can be sent after a month from the date of application to the FIU.
Can a working teacher refuse to receive an early pension? Maybe. In this case, the provisions of paragraph 15 of Art. 15 and paragraph 5 of article 16 of the Federal Law No. 400 on the accrual of increased points for the entire period of refusal to receive an early pension and an increase in a fixed additional payment of a pension. At the same time, the teacher retains the right to apply for the assignment of a pension to him at any time at his request.
