Shepelev's lawyer in court said that two weeks before the death of the singer, the unspent part of the charitable assistance was cashed out by Olga Friske. In his opinion, she should be accountable. Shepelev and Zhanna Friske's parents do not get along with each other.
Rusfond received evidence that a little more than 4 million rubles were spent on treatment. Where is the other 21.5 million? The defendants' lawyers say that they simply did not have time to collect the necessary papers, explaining this by the fact that Zhanna Friske was being treated abroad. Nikolai Zhukov, head of the department for optimizing the treatment of adolescents and young people with cancer at the Rogachev Federal Research and Clinical Center for Pediatric Hematology, Oncology and Immunology, claims that foreign clinics provide all the necessary documents very quickly. He also doubts that 21 million rubles could have been spent on treatment in two weeks. However, it is possible that this money closed previously issued accounts, says expert Nikolai Zhukov, head of the department for optimizing the treatment of adolescents and young people with cancer at the Rogachev Federal Research and Clinical Center for Pediatric Hematology, Oncology and Immunology:
“It is quite possible that people withdrew money in order to pay for services already rendered. In principle, it is possible to spend this amount for a semi-annual-annual cycle of treatment at the cost of modern anticancer drugs. I don’t dare to say, but, most likely, she received new immune drugs, and they are really expensive.”
For several years now, many social media users have been criticizing the fundraising campaign itself: why was it necessary to raise money for the treatment of a show business star, including from housewives and pensioners, was it really impossible to turn to friends and relatives, obviously wealthy people, why do from the tragedy of PR? Philanthropists interviewed by Business FM do not share this view. Help is not about the thickness of the wallet, but about the willingness to provide support, people themselves wanted to do it. But even this story, which now, of course, casts a shadow on the very concept of “charity”, is still useful as a lesson for society, believes Ekaterina Chistyakova, Program Director of the Gift of Life Foundation:
“If there is no evidence of targeted spending of funds, then this is considered income and is taxed. If the relatives really spent money on something that they should not have spent it on, then they must pay the state income tax. Of course, this will be a deception of benefactors. I think that people should learn how charity works, what stories can happen. Our foundation, for example, simply does not give any money to those who need our help. We buy medicines or pay for those medical services that need to be paid for directly, without transferring money to the patient's relatives. Such stories can and should be avoided. That's all".
Zhanna Friske herself, even during the action of Channel One, thanked everyone who supported her, and stated that much more money had been collected than needed. She then sent over 30 million rubles to pay for the treatment of nine children with cancer.
The angry public believes that the family of the late singer, who profited from Zhanna Friske's illness, should "receive in full", and not just give the embezzled money collected by Rusfond for the girl's treatment.

On the online platform Change.org, where various petitions and appeals are published, a demand has appeared "to oblige Zhanna Friske's family to pay three times the amount transferred to her, subsequently vilely stolen," the Dni.ru portal.
"As you know, the lawsuit related to the loss of Money from the account of the singer Zhanna Friske, came to an end. The Friske family, including her son represented by Dmitry Shepelev, must return 21.6 million rubles to Rusfond. This decision has already entered into force," the petition reads.
“It is necessary to demand penalties and interest from them for each day of misappropriation of money, for each deceased child who did not wait for help. The parents of the late Zhanna Friske cashed out and withdrew a huge amount from their account, knowing that nothing could help their daughter,” they write document authors.

In addition to the above measures, it is proposed to confiscate the property of the family and prohibit all its members from traveling abroad until the full repayment of the embezzled amount, together with interest. The authors of the petition draw attention to the fact that they have already sent relevant petitions to the Perovsky Court, Rusfond and Federal Service bailiffs.
In their comments, numerous users are in solidarity with the author of the appeal and believe that the Friske family "should get what it deserves."
According to approximate estimates, the amount of Zhanna Friske's inheritance is about 90 million rubles. It includes: an apartment in Shmitovsky proezd, a parking space, a Range Rover car, half country house and a plot in the Istra district of the Moscow region. As well as bank accounts, one of which has about half a million euros.
On August 10, the Perovsky Court rejected the appeal of the relatives of the singer who died three years ago and recognized as legal the decision that the funds collected for the treatment of the ex-member of the "Brilliant" group and appropriated by her family would be recovered from her relatives.
Zhanna Friske died in 2015 from inoperable brain cancer. About 21 million rubles were collected for her treatment, but the relatives provided the court with documents to pay for treatment only in the amount of 4.12 million rubles.
Relatives of the artist continue to reject claims against them. On Thursday, the Moscow City Court considered the complaint of Vladimir Borisovich and Olga Vladimirovna. Relatives of Zhanna Friske insist that her contract with a charitable organization may be invalid.

Relatives of the famous singer demand to interrogate witnesses - the chairman of Rusfond, Lev Ambinder and other representatives of the organization, as well as employees of the bank where the contract was concluded. In addition, they consider it necessary to bill the artist's phone and analyze her messages. Vladimir Borisovich and Olga Vladimirovna declare that it is necessary to establish where their daughter was on October 19, 2014, the day the agreement was signed.
However, today the appeals of Zhanna Friske's parents were rejected. Thus, the previous decision of the Perovsky Court of May 19 to recover from her relatives, including from little Plato, millions collected by TV viewers and Rusfond, has entered into force.
Earlier, Dmitry Shepelev, the official representative of the artist's heir, said he did not agree with the decision of the Perovsky court. According to the man, he did not withdraw funds from the accounts of Zhanna Friske, since he did not have access to them. The host expressed his joy that he was not found guilty of misappropriation of funds collected for the treatment of his common-law wife. At the same time, Dmitry, being the parent of little Plato, was dissatisfied with the decision to recover millions from the child.
“I understand how important this case is for the charitable movement in Russia and I am glad that the reputation charitable foundation Rusfond has been restored. But as a father, I am indignant. (...) I will continue to fight for the only thing that is important for me in this situation - the well-being and peace of my son, and, of course, I will appeal this court decision, ”said the TV presenter.

The scandal erupted after the death of the singer. It turned out that the money for treatment, which was collected by the whole world, had disappeared. Rusfond, which always publishes reports on every ruble spent, turned to the investigating authorities. The court ruled: the Friske family is obliged to return the money. All Rusfond funds will be directed to the treatment of seriously ill children.
Three years ago this news sounded like a bolt from the blue. On Channel One, the common-law husband of Zhanna Friske, Dmitry Shepelev, announced: the singer is terminally ill. Friends, colleagues of Jeanne, who gathered in the studio, urged viewers to help the family raise funds for expensive treatment.
SMS with the word "ZHANNA" then sent hundreds of thousands of caring people who, together with their families, believed in a miracle. In a matter of days, tens of millions of rubles were collected. These funds were transferred to a special account opened with Rusfond, a long-standing and reliable partner of Channel One. Since 2011, we have been holding a campaign to raise money for seriously ill children.
Rusfond transferred the collected amount to Zhanna Friske's account. After paying for the first phase of treatment, a little more than 25 million rubles remained. The singer's relatives had to report how much money was spent and where. Even during Zhanna's lifetime, Rusfond received documents for over four million rubles. But what happened to the rest of the money is still unclear.
Today, the Perovsky court of the capital issued a decision to recover the missing amount. The defendants are the singer's heirs: her parents and son Platon represented by the legal representative Dmitry Shepelev.
“The court decided: to satisfy the claims of the Rusfond Charitable Foundation against Olga Vladimirovna Friska, Vladimir Friska, Platon Dmitrievich Shepelev represented by Dmitry Shepelev’s legal representative for the recovery of funds, collect jointly and severally 21 million 633 thousand against the return of funds issued for the treatment of Friska Zhanna Vladimirovna,” read the judge of the Perovsky Court of Moscow Sergey Savostyanov.
This scandal broke out almost immediately after Jeanne's death, when it turned out that not a penny was left of the donations. The account was empty. Rusfond said that after the death of the singer, they contacted Jeanne's relatives several times with a request to provide documents confirming that the remaining amount was spent on paying medical services. But they didn't achieve anything. In court, the lawyers of the Friske family tried to prove that their clients did not owe anything to Rusfond.
“Rusfond could not make any demands on us, expose our representatives as persons obliged to fulfill something. All other arguments were heard in court,” the lawyer said. According to him, an appeal will be filed.
Shepelev's representatives emphasize that according to these banking documents Zhanna Friske's mother should be responsible for the loss of money. The certificate from the bank, which the lawyers showed us, says that it was the singer's mother who withdrew the entire remaining amount two weeks before her daughter's death.
“It is clear that neither I nor my son had anything to do with this money, had nothing to do with these accounts. We just didn't touch them. Two weeks before her death, charitable funds were withdrawn by her mother, Olga Friske. How this money was spent is completely unknown to me, but it is obvious that it is no longer possible to save a dying person in a few weeks. The most important thing that hurts me is that my son should be responsible for this by a court decision, ”said Dmitry Shepelev.
Where the money is, Rusfond wants to know not just out of curiosity - even during the action, viewers of Channel One were promised that the amount remaining after Zhanna's treatment would be used to help seriously ill children. In addition, Rusfond itself must regularly report how much money was collected and how it was used - philanthropists must be sure that their donations will definitely reach the addressee.
“An agreement was concluded between the fund and Zhanna in writing, where there were signatures, and it contained a condition that the unused part of the funds is subject to return at the moment when it becomes impossible to use them for the intended purpose specified in the contract. It is known that the end point of the cut-off is the death of a person,” Rusfond lawyer Ivan Shienok said.
Neither the father of Zhanna Friske, nor his lawyer began to comment on the verdict of the court to Channel One. The defendants have a month to appeal the verdict.
