"Federal Law of March 8, 2015 No. 42-FZ" On Amendments to Part One Civil Code Russian Federation"(Hereinafter referred to as the Law), which entered into force on June 1, 2015, the wording of Article 395 of the Civil Code of the Russian Federation has been changed.
So, according to paragraph 1 of Article 395 of the Civil Code of the Russian Federation in new edition the amount of interest is determined by the average rates of bank interest on deposits of individuals that exist at the place of residence of the lender or, if the lender is a legal entity, at the place of its location, published by the Bank of Russia and taking place in the corresponding periods. These rules apply unless a different interest rate is established by law or contract.
In this regard, many participants in the process have a question: how is the amount of interest for the use of other people's funds determined in accordance with Article 395 of the Civil Code of the Russian Federation as amended Federal law dated March 8, 2015 No. 42-FZ "On Amendments to Part One of the Civil Code of the Russian Federation"?
The Arbitration Court of the Republic of Buryatia offers for familiarization, developed by the Economic Collegium The Supreme Court RF, recommendations for determining the amount of interest under Article 395 of the Civil Code of the Russian Federation.
By general rule the calculation of interest in accordance with the new edition of Article 395 of the Civil Code of the Russian Federation is made on the basis of information on deposits of individuals published by the Bank of Russia on its official website on the Internet.
In the new edition of Article 395 of the Civil Code of the Russian Federation, it is established that the amount of interest is determined by the rates that took place in the corresponding periods of time, and not on the day the claim was filed or on the day the decision was made, as it was established in the previous edition of this provision. Therefore, for each period of delay, the calculation is carried out based on the average rate (rates) of the bank interest in this period, and if the rate for corresponding period unpublished - based on the latest published rate.
Interest is calculated at the rate prevailing in the federal district in which the lender's place of residence (location) is located. If the creditor is a person whose place of residence (location) is outside the Russian Federation, the calculation is carried out at the rate prevailing in the federal district at the location of the court considering the dispute.
Within the meaning of clause 3 of Article 395 of the Civil Code of the Russian Federation, interest for the use of other people's funds shall be charged inclusively up to the date of payment of the amount of these funds to the creditor, if by law, otherwise legal acts or the contract does not establish a shorter period for calculating interest.

- making a real profit between the difference in the nominal interest rate on the deposit and the inflation rate;
- control over the growth of inflation in order to avoid the appearance of a threat of depreciation of monetary investments.
The main work of the Central Bank of the Russian Federation is aimed at monitoring percentage indicators in different regions of the Russian Federation where the best banks showing impressive and competing results in terms of the volume of attracted deposits of individuals.
For the entire economy of the country, it is extremely important to be able to correctly calculate the average size of the depositor's profitability. These indicators are the main ones in the formation of the loan portfolio. financial institutions, the ability to attract funds from individuals and inspire confidence in them.
Calculation formula
Due to the huge amount financial institutions offering different conditions for opening a deposit account, the average value is formed.
From June 1, 2015, for each federal district, the Central Bank established an individual average rate and the timing of its application. By offering one or another deposit product, the bank forms a specific range of interest rates, under which it is ready to provide deposit services and receive additional profit.
Several factors affect the receipt of the average and permissible value of the interest on the deposit:
- refinancing rate in the state. The larger its value, the higher the bank will be able to establish the level of profitability in terms of cash investments. It should be borne in mind that such a jump contributes to the rise in the cost of loans, therefore, a certain balance is needed;
- the current state of the economy, when it is necessary to take into account and control the inflation rate, the availability of resources from banks, other loans taken by the state, the presence of debts;
- the terms of the deposit itself and the longer it is, the higher the percentage will be.
It should be borne in mind that the bank has no right to unilaterally change the amount of interest yield before the expiration of the contract. The calculation formula also determines the profitability of the future investment. It is important to carefully read the terms of the agreement, where the procedure for calculating the accrual of profit will be indicated and it is better if it is possible with capitalization.

What it is
Bank interest rates are made up of numerous indicators formed in the course of the work of financial institutions, based on the specific economic situation in the countries. The whole process is monitored by the Central Bank and publishes the results of its work on the official website in accordance with Art. 395 of the Civil Code of the Russian Federation.
To obtain the correct figures, it is necessary to take into account the indicators of the largest banks, their annual performance indicators, the degree of attracting capital from individuals, as well as a number of other indicators:
- the most popular types of deposits on Russian market with payment of interest at the end of the end of the contract;
- deposits from monthly payments profit and other options for making incoming and outgoing transactions.
The amount of the deposit does not have a special effect on the size of the interest rate. Economic situation in the region and financial indicators form the average size of the bank interest on deposits.
Reasons for the popularity of deposits
The demand for deposits has a direct impact on the size of the average rate.
The reasons for this popularity among the population are due to the following factors:
- trust in savings to a reliable and trusted bank;
- deposit insurance and guarantee of reimbursement of up to 1.4 million rubles;
To provide guarantees for the safety of savings of individuals, a whole Deposit Insurance System has been created, consisting of certain measures controlled by the state.
This includes the obligation of banks to make systematic contributions to the Deposit Insurance Fund. Also checking banks for compliance with the requirements of the Central Bank, giving the right to carry out banking and offer deposit services.
In the event of any difficulties in the work of the bank, all obligations are assumed by the Bank Deposit Insurance Fund.

In April 2020, the Central Bank set the average profitability on transactions with deposits of individuals for a period of 365 days at 10.824%.
If this value is exceeded by more than two points banking institution will be obliged to pay double contributions to the Deposit Insurance Fund. It also threatens with additional checks by the Central Bank of the Russian Federation.
The Central Bank of Russia uses various data, subsequently, summarizing them and issuing an average value of the size bank rate, namely:
- minimum terms for placing funds;
- the presence and absence of the possibility of capitalizing the deposit;
- terms of the possibility of cash withdrawal without loss of accrued interest;
- replenishment of the account during the validity of the contract.
After receiving and comparing the data of the Central Bank of the Russian Federation, two types of calculation are used using a simple and complex formula.
In order to profitably invest in a particular bank, it is necessary to take into account a number of important rules:
- it is best to open a deposit for a period not exceeding 12 months;
- short-term deposits are also safe for a financial institution, as it will be able to promptly react to any external economic changes and make the right decisions to preserve the savings of individuals.
The real profitability of the deposit depends on the inflation rate and the interest rate. The difference between these two indicators will determine the average deposit rate.
The profitability of a particular type of deposit is calculated and determined in the same way. Negative values are not excluded, resulting from the excessive increase in inflation, which devalues deposits much faster than they have time to increase again.
Already at the end of 2015, the Central Bank makes positive forecasts for 2020, which can be observed even now, the average level of income on deposits in the range of 9-10% with an inflation rate of no more than 10%.
It is possible that rates will have to be reduced to 7-8% on long-term deposits. This will allow depositors to confidently deposit funds with the bank.
By federal districts
More accurate forecasts of the average return on deposits can be made if you study the proposals of specific financial institutions in a specific region. This will allow you to find out the most advantageous offer for the period of the future placement of deposits.
The central bank systematically publishes 12-month deposit values. So, you can observe a drop in the indicator from last year to the beginning of 2020. As of April 20, 2020, the average rate reached 9.74%, which is three points lower than last year.
According to the indicators of the Bank of Russia, the following rates are established on deposits as of May 19, 2016.
It should be noted that the situation in the global market is unstable. Changes in interest rates, liquidity of banks, competition, financial crisis- all these components affect the bank interest on a daily basis.
The data published by the Central Bank allows you to make profitable investments in a specific period of time by choosing the appropriate Federal District.
To attract individuals, banks are developing all kinds of programs that have individual conditions for pensioners, salary clients, students and other categories of citizens.
