Article 21 of the Federal Law No. 14 allows the possibility of restricting the departure of a minor on the basis of an application from one of the parents. Challenge this decision, possibly in court.
The application itself can be submitted without justifying a reason.

If the defaulter has not paid off his debts, then a new ban on travel restrictions may be imposed.

There are two ways out:
- Pay all your debts.
- Agree with the bailiff for permission to leave, on any terms, for example, partial repayment debt.
If the ban has already entered into force, then it is not enough to pay debts.
There are a number of other steps to be taken:
- Provide the bailiff with a copy of the payment receipt confirming the repayment of the debt.
- Ask for a copy of the decree on the abolition of restrictions on leaving the country, certify with a seal with the coat of arms and signature of the chief bailiff.
- Clarify whether the documents have been sent to the central unit of the Border Guard Service. When was sent and how long to wait.
This whole procedure takes two weeks. This usually does not happen faster.
Is it possible to receive compensation for damages from the bailiffs who banned the exit?
Yes, it is possible to compensate for the losses. But only if, for example, the decision to initiate enforcement proceedings was not sent to the debtor, or if the prohibition itself was not notified. It will be possible to claim compensation only through the courts.

Many of our compatriots take on loans that are needed to buy real estate, cars or other large objects. Not everyone is able to pay them off on time, so a possible trip abroad with debts is quite difficult, especially if it is urgent.
Of course, not all of a citizen's debts will not allow him to leave, but only from 30 thousand rubles - this amount was established by law in 2017, but at the end of this year a proposal was considered to increase it in connection with the devaluation and denomination of the ruble. While this question remains open, so that travel restrictions before going abroad have remained at that limit.
Options to check debts before going abroad
We discussed the topic in more detail in a separate article.
Yes, if you have debts, bailiffs cannot release you abroad. They do this by sending a special notification at the place of registration - if there is one, the loan debt will need to be paid at least a day before departure, otherwise there may be problems with the border guards.
But often a person simply does not know whether he has a loan debt, whether he will be released to another country. But do not despair to find out, there are several methods:
- Shows debts abroad to the traffic police, the database of which is on the Internet;
- Public services - will show all information about a person;
- Federal Tax Service - will show all debts, not only on loans or borrowings, but possibly alimony or fines;
- Website or mobile bank where the client took the loan;
- From 2019 it will be possible.
But all these methods are inconvenient, because registration is required to obtain information, for each type of debt you need to visit your website - fines for a car at the traffic police, loans - at a bank, taxes - at the Federal Tax Service, and only the FSSP and State Services will show everything. But these methods can be used for a long time, because they require the selection of the necessary information, confirmation of identity - for example, in State services it takes several days, and it is also easy to make mistakes in finding this, which will attract a travel ban.
And yet, if you are afraid that you will not be allowed to go abroad with debt exceeding the minimum allowable amount, then you can easily. In three clicks, you will receive all the information about the debt. To fill out, you will need information about your full name and passport number.
In response to filling in these fields, the automatic robot will search for debts on all points and give an answer, and you will only have to pay the bills and safely travel abroad.
How to go abroad with loan debts
If you do not have time at all to search for information about the debt or payment of the amount, then there are several ways to leave Russia with debts. It should be remembered that none of them are 100% guaranteed. So, all three methods are associated with the use of the border of a friendly state where there is no border control.
Method 1: Belarus
The easiest option is to leave Russia across the border with a friendly state, namely, Belarus... For example, you can fly or go by car to Minsk, and from there to your destination (tickets to the final point are already better taken in Minsk). Though recent times The Russian Federation and Belarus have begun work on the restoration of the state border, but in reality it does not exist a single base debtors from Belarusian and Russian border guards, leaving and entering Belarus you will bypass border control - this is a fairly safe way. But it should still be remembered that the Russian Federation and the Republic of Bashkortostan may soon again plan to close the border and not allow alimony, debtors and other debtors. While the border is open, the Belarusian customs officers release Russian citizens from the country with any debts, and the Russian ones have no right not to let them back into the country. But everything can change at the most inopportune moment.
Hey! With a closed exit since 2015. The debt to creditors is large. For family reasons, he is often forced to travel outside the country. The scheme is the same, I do not leave through the Smolensk region, but through any bordering settlements of the RF RB according to the Russian passport, not everywhere there are hospitals. In the Republic of Belarus there is no common base, if you find yourself in the Republic of Belarus, then you don't care already for debts, etc., and even more so for them. Departure is free to anywhere in the world. It will not work with airports in the Russian Federation, customs are everywhere. Kazastan did not even consider. The meaning is this. With RB we order a ticket and fly. We return as we like, at least through Moscow, at least how, but I have a car left in the Republic of Belarus, so the way back is also through the Republic of Belarus. Customs officers don't care about your debts in the Republic. Further, everyone chooses the path of how to get to the Republic of Belarus - bus, car, taxi, hitchhiking.
Alexey, end of 2018
Update February 27, 2019. According to Kommersant, an agreement between Belarus and Russia on the exchange of information about debtors and people who are prohibited from entering or leaving should come into effect this spring. In fact, this is not the first time such ideas have been discussed, and perhaps once again the system will continue to work carelessly or selectively, only slightly complicating the process. So far, everything continues to work! In addition, this will not in any way affect the option of purchasing a train ticket to Kaliningrad, which is discussed below.
Belarus - Update 7.03.
Already in March 2020, the Ministry of Internal Affairs of Russia and Belarus jointly want to create a list of citizens restricted to travel abroad, Kommersant reports. Agreements were signed on the exchange of information on the migration of citizens. These measures have not yet been signed by the presidents of the countries, but, given that the Russian Federation and the Republic of Belarus are already closely cooperating in economic sphere- doubts about close migration cooperation do not arise. In this regard, closer to spring there will be difficulties in crossing the border for citizens with large debts. In our opinion, the list of citizens restricted to travel abroad at first will consist only of notorious debtors.
Method 2: Lithuania
If you have previously traveled to Europe and have a valid Schengen visa, then the following method may work. A ticket is purchased for the Moscow - Kaliningrad train, following to the final destination. In this case, you do not seem to show your intention to leave the country, but simply travel. But you leave the train in Vilnius, Lithuania, from where you can get to any European country with some cheap Vueling or Ryan Air without any problems.
Supplement (2018): You don't have to take a ticket to Kaliningrad itself, but it is better to buy it before the first station after the border: to Chernyshevsky, it will turn out much cheaper
Don't forget to read the comments to stay up to date with the latest changes! If you decide to cross the border in one of the above ways, we and other users will be grateful if you share your experience.
Federal legislation defines cases restricting travel individuals From Russia.
So, the "restricted to travel abroad" include conscripts, bankrupts (insolvent), convicted, and debtors, that is, persons who evade the fulfillment of obligations under court decisions.
So how can you find out if the debtor will be released abroad?
It is about the ban on the departure of debtors from Russia that will be discussed.
So, how to find out if there is a ban on leaving Russia, we will talk further.
How to find out if there is a ban on leaving Russia?
Important! It should be borne in mind that:
- Each case is unique and individual.
- Careful study of the issue does not always guarantee a positive outcome of the case. It depends on many factors.
To get the most detailed advice on your issue, you just need to choose any of the options offered:
You can find out if you have a ban on leaving Russia in several ways.
Who can impose a travel ban?
The bailiff - the executor restricts the departure of the debtor from the country by means of an order on the temporary restriction of the debtor's departure, which is issued only in enforcement proceedings. For this resolution, it is mandatory to issue a visa for the senior bailiff or deputy, it is worth noting that the head of the department is also endowed with the right to draw up this act. A temporary ban of the debtor from leaving the Russian Federation is a procedure aimed at forcing the debtor to take actions prescribed by the executive document, for example, to pay money. The imposition of a ban on leaving does not mean that other enforcement actions will not be carried out.
Case Study: Bailiffs Service
For example, citizen K. owed citizen P. 100,000 rubles under a writ of execution issued by the Kirovsky District Court of the city of Yekaterinburg. P. presented this performance list to the department of bailiffs at the place of residence of the debtor K. for collection. The bailiff established a 5-day period for voluntary payment for debtor K., indicating that otherwise, at the end of the established period, performance fee, the property is encumbered and travel abroad is limited.
By the way, upon presentation of an executive document that was previously on execution in the FSSP and returned to the claimant, for example, with the impossibility of collection, the claimant, upon re-presentation, can simultaneously submit a reasoned application for a temporary restriction of departure. The bailiff, if the stated motives are recognized as convincing, when initiating enforcement proceedings, will restrict the debtor's departure from the country.
Deadline expired
Since the term appointed by the bailiff passed, and K. did not pay the debt, the bailiff began enforcement... From the responses received to requests from credit institutions and registering authorities it became known that the debtor has an account in one of the banks, she is employed, but there is no property registered with K. TO FMS provided an answer that the debtor has a passport, with current term... Having foreclosed money and income, the bailiff decides to restrict K.'s departure from Russia.
Grounds for establishing a temporary travel restriction
The establishment of a temporary restriction on leaving the Russian Federation can only be under an act issued by a court, with a debt of more than 10,000 rubles or of a non-property nature, according to which the term of voluntary execution has passed. If the executive document does not apply to a judicial act, then the bailiff or the claimant sends an application for a temporary restriction on the debtor's departure to the district court, and with the permission of the court, the bailiff makes a restriction. A ban on leaving with a debt of less than 10,000 rubles is unacceptable and the issued resolution in this case will be illegal.
Term
So, the bailiff decides to restrict K.'s departure from Russia for a period of 6 months (the usual duration of the restriction) and sends the decree to the debtor, the TP of the FMS and the executor, which is the Border Guard Service of the FSB of Russia. The decree is terminated only after the expiration of the validity period or the receipt of a decree from the FSSP to cancel the restriction. There are no other grounds for lifting the restriction, and the Border Guard Service will not be able to cancel the resolution on its own. It should be noted that the procedure for lifting the restriction takes a long time due to the need for interagency cooperation.
How to lift the ban on traveling abroad?
Is it possible to lift the ban on traveling abroad and how can this be done?
- Firstly, if you think that the sanctions imposed on you are unlawful, you have the opportunity to appeal the relevant decision within the time limit established by law. In the resolution, the bailiff indicates the way to appeal the restriction, which occurs by filing an application with the district (city) court within 10 days.
- Secondly, a trivial solution is to pay off the debt itself, as a result of which you were imposed a restriction on traveling abroad. After full payment debt and in other cases when enforcement proceedings are subject to completion, the bailiff, no later than the day following the day of payment, cancels restrictions and encumbrances, including restrictions on leaving the country. The right to appeal the cancellation of restrictions belongs to the parties to the enforcement proceedings, that is, the debtor and the claimant.
A temporary restriction on traveling abroad may not have any effect if the debtor has not crossed the borders of Russia, and does not plan in the future, or vice versa, be effective when a trip abroad for the debtor is an urgent need.
And as statistics show, on a national scale, this measure is quite effective, so in 2011, officers of the bailiff service restricted travel abroad for 118 thousand persons with alimony debt, and as a result of these measures, about 184 million rubles were collected in arrears.

How to find out whether they will be released abroad if there are debts, fines, loan arrears in 2019? We will tell you how to check whether a person is traveling abroad or not online and what to do if there is a debt.
The article consists of several parts:
- Under what conditions may they not be released abroad
- How to check if there is a travel ban
- What to do if there is a debt / prohibition
- Tips & Tricks
Under what conditions are they not allowed to go abroad?
In 2019, there is only one condition under which you may not be released abroad due to debts or fines - if the court ruled to collect the debt and the bailiff started enforcement proceedings. If there is no such production, there will be no problems with customs clearance.
All this is regulated by the Federal Law "On Enforcement Proceedings" and the Federal Law "On the procedure for leaving Russian Federation and entry into the Russian Federation ”.
The difficulty lies in the fact that if you have debts, overdue loans, fines - enforcement proceedings can start a few days before departure, and you will find out about this already at the airport.
You may not be allowed abroad:
- if there are tax debts (land, transport, etc.)
- if there are traffic fines (unpaid)
- if there are debts on a loan, rent, alimony, housing and communal services
- if there is a loan debt
- other debts and non-payment
How does this happen:
- You have a debt, an unpaid fine, a debt on housing and communal services, etc.
- Bank / organization representatives take legal action. You will be sent a summons, but the court can make a decision without your participation.
- If the charges are substantiated, a debt collection decision is made and the case is referred to the bailiff of your site.
- The bailiff decides to restrict the debtor's departure and initiates enforcement proceedings; the information is sent to the border service of the FSB of Russia and your data appears in the debtors' database.
- You are not allowed to travel abroad at the airport.
Limit of 10,000 / 30,000 rubles
There are certain concessions in the legislation that allow you to travel abroad with debts, even if a court has made a decision and bailiffs instituted enforcement proceedings.
Since 2018, if the debt does not exceed 30,000 rubles(or 10,000 rubles, in some cases - see Art. 67 FZ-229 "On Enforcement Proceedings") - the bailiff has no right to make a decision to restrict travel outside the Russian Federation. In this case, the person remains traveling - he will be released abroad, there will be no questions at the airport.
Sometimes you can leave the country even in the case when enforcement proceedings are instituted and the debt is more than 30,000 rubles. The decision to ban the exit is made by the bailiff, and it is not always made. There are cases when people went abroad and with debts of 100,000 rubles.
How to find out whether they will be released abroad via the Internet
Where to check whether they will be released abroad online? There are 2 main services where each person can find out whether he is traveling abroad or not.
1. FSSP website
What to do if there is a debt
There are only two options:
- If we have already started enforcement proceedings and the amount of the debt exceeds 30,000 rubles - it necessarily must be repaid, otherwise they will not be released abroad.
- If there has not yet been a court decision or the debt does not exceed 30,000 rubles, you can not pay anything. But at the same time, the risk remains that the case will be opened later and you will be stopped at the border - it is better not to risk it and pay debts and fines.
Important: information about the repayment of the debt reaches the border guards and bailiffs with a delay (up to two weeks). For this reason, it is recommended to pay debts at least 14 days before departure.

How to pay off debt correctly
You can pay off debts, fines and other debts on a receipt at the bank or on the Nevylet.rf website.
After payment, it is desirable to receive a copy of the FSSP orders to terminate enforcement proceedings, which indicates that the ban on traveling abroad is also lifted from you.
It is the termination of enforcement proceedings, and not the payment of the debt, that is the condition under which you can be released abroad.
The ban on traveling abroad is a measure that bailiffs apply to debtors, thereby forcing defaulters to return unpaid amounts. The method is regulated by the Federal Law "On Enforcement Proceedings". The defaulter is deprived of the opportunity to cross the border of the Russian Federation until he fully repays the debt. Meanwhile, not every tourist thinks about whether I am an outbound tourist? You can check the ban on traveling abroad in a couple of minutes using the online service or this form:
It is unpleasant to be on the “black list”. It is even more unpleasant to find out about this during passport control at the airport. Practice shows: from time to time it will not be superfluous to check the absence of one's own surname in the database of bailiffs.
The procedure for imposing a ban on leaving Russia is complicated and not fast. The court imposes restrictions. Reason - default by the debtor monetary obligations... This usually applies to citizens who evade payment for a long time and have accumulated significant amounts of debt.
For respectable payers, the prospect of being on the "list of restricted to travel abroad" is small. And the probability of getting there without your own knowledge tends to zero. However, cases are known. Therefore, you need to check whether I am traveling outside the border before buying tickets and planning a trip.
Types of debts
Restrictions on travel threaten persons with debts under various articles. These are alimony, taxes, overdue loans, unpaid fines and even housing and communal services.
Decisions on administrative violations also become grounds for initiating enforcement proceedings. Different bodies carry out: traffic police, tax office, police, customs, labor inspectorate, etc.
So, the traffic police can send the material to the bailiffs if the fine for traffic violations is not paid within 30 days. In theory, doubts about whether I am an exit person should arise from anyone who has neglected the rules and deadlines in everything related to money.
- Employees with access to state secrets. The ban is valid during the period of tenure and for some time after dismissal.
- Conscripts for military and alternative service.
- Suspected of committing a crime, accused or convicted.
- FSB employees.
- Persons who were caught in forgery during the registration of documents for departure.
Order of imposition of restrictions
According to the legislation of the Russian Federation, the initiator of the ban on travel abroad can be a court or a bailiff. In real life, courts rarely initiate a procedure. In the overwhelming majority of cases, the travel restriction is drawn up by a bailiff, relying on judgment or order. There are differences between the documents.
This is what the travel ban decree looks like
- The judgment is the result of a court hearing. The debtor is notified in advance. Then he himself decides whether to attend the hearing or not. If the defaulter is not present at the meeting, this does not exempt from subsequent punishment.
- The court order does not provide for the presence of a citizen. The order is sent in the form of a notification.
The purpose of the documents is the same: to make the citizen pay the debt. Having received a court decision or order, the bailiff prepares a decision and notifies the debtor that the court has considered the case and ordered to recover the sum of money. Otherwise, he faces a ban on traveling abroad.
The bailiff's decree indicates the time allotted for the transfer of money, the amount and details for payment. At least 5 days are given for repayment. If the money is not received, the bailiff prepares a second order, which imposes a travel restriction. Copies are sent to the debtor, the FMS staff and the border control service.
In the base of the border guards there are lists of persons in respect of whom the travel ban is in effect. It does not matter how the citizen planned to leave the territory of the Russian Federation. The passport will be checked in any case. If a corresponding record is found in the databank of enforcement proceedings, the departure or departure will have to be canceled. A citizen will not be released abroad.
The law established minimum amount, starting from which the defaulter will not be allowed abroad. In 2020, this is 10 thousand rubles. The term for which the travel ban is imposed is not specified in the law. By default, it is assumed that a person can receive admission immediately after payment of the debt. However, if the amount is large, it is rarely paid immediately and in a short time. Therefore, a citizen remains restricted to leave for six months. After 6 months, the bailiff issues a new resolution - and so an infinite number of times.
Remember: until your "debt" history is in the hands of the bailiffs, no one has the right to prohibit you from leaving the territory of the Russian Federation. If the performers paid attention to you, the ban on traveling abroad should be preceded by a large number of notices, notifications and letters demanding to pay off the debt. Therefore, it is difficult to get into the "black lists" and not know about it.
How to get rid of the ban
There are different ways to lift the travel ban. The first and most sure thing is to eliminate the debt. This must be done in advance, so that the bailiff will issue an order on withdrawal and send it to the FMS and the border service. Those, in turn, must check the list of people for whom the exit is closed, and delete the former debtor.
The second way is to file a complaint against the actions of the bailiff. The method is risky. Suitable for those who are extremely confident in the rightness and can prove. In other cases, actions are doomed to failure in advance.
To check whether I am traveling or not, everyone leaving for another country must in advance (there is a convenient website for a quick check). The bureaucratic machine is designed in such a way that it is impossible to instantly remove the restriction on travel abroad. As in the case of imposition, the order of withdrawal is the prerogative of the bailiff.
The main department of the FSSP enters information into single register, then forwards the information to the FMS specialists. This takes 3 weeks. A citizen who goes abroad and doubts whether he is traveling, should take this into account.
In 2020, a round-the-clock duty of bailiffs was introduced at airports. This is done so that the citizen can pay off the debt immediately before departure. This method is quick, however, it also takes time. On average, it takes 5-6 hours to complete a payment and change data. Therefore, the plane will most likely have to be late.
Verification methods
Debt Checker Mobile Application
There are different methods of how to find out if there is a travel ban. The surest way to never face the question "Am I traveling or not?" Is not to accumulate debts. Pay alimony, loans, utility bills on time. Enforcement proceedings are launched not because a person has a debt, but because the debt is being serviced with violations.
The fastest way to check is online service from our partners.
Another way is to use a special service on the website of the bailiff service. The check works online. The user is required to enter the region, last name, first name and date of birth.
If the system does not return matches, then there is no such person in the database, and travel abroad is allowed. If information, on the contrary, is found, they need to be checked by contacting the bailiff personally.
Explanations on the use of the service
A detailed memo to the user of the production data bank is posted on the official website FSSP Office Russia http://fssprus.ru. It is allowed to create a database of debtors the federal law No. 229-FZ "On Enforcement Proceedings". The publicly available part is posted on the site (you can check it through this service). Nuances judicial proceedings and documents are not posted on the Internet.
You can check if I can be mobile if I refer to the search for individuals. The region of registration or location of the property should be indicated. Citizens do not have to celebrate the date of birth. It is designed to identify users with the same first and last name.
If the debtor knows the number of the enforcement proceedings, he can start a search by number. The data that the user enters into the form, the system does not save or transfer to third parties.
If there is information in the database, travel abroad is prohibited. The Office of Bailiffs recommends that those who find themselves on the "black list" to pay off the debt. This can be done on the website online using electronic systems payments or bank card.
After the payment is accepted, the record is kept for another 4-7 days, after which it is deleted. This happens when the money is credited to the account and sent to the recipient. After that, the debtor can once again send a request, assessing whether I am traveling outside the border. If you have any problems, it is better to contact bailiffs personally.
In 2020, spread were mobile applications, with the help of which it is easy to enter the data bank. Programs in mobile phones and social networks allow you to subscribe. When your surname appears in the database, you will instantly receive a notification by mail.
