This conclusion, according to the Kommersant newspaper, was made by specialists from the Control and Accounts Chamber of St. Petersburg (KSP). According to the auditors, the State Unitary Enterprise has no right to collect money either for a “communal apartment” or for major repairs.
It is worth recalling that the possibility of the work of the city housing and communal services without a computer center was actively discussed by the former vice-governor Vladimir Lavlentsev. It was reported that since January 1, 2015. a city can earn a single sales agent who will print receipts for all utility bills, including electricity. This reorganization is being lobbied by Inter RAO, which is led by Boris Kovalchuk, the son of Yuri Kovalchuk (Bank Rossiya). But soon V. Lavlentsev left his post, giving way to Igor Albin. The VTsKP itself denied the accusations of the auditors. “The Housing Code of the Russian Federation does not prohibit being guided by the provisions of the Civil Code of the Russian Federation on agency functions, described in Article 1005 of Chapter 52 “Agenting,” Alexander Loktionov, head of the development department of the VTsKP, quotes the publication. — The "integrated" service model of the VTsKP provides significant benefits for citizens, managers and resource-supplying organizations. Loktionov recalled that about 70% of St. Petersburg residents receive pink receipts of the VTsKP, while they are not charged additional commissions in favor of banks or terminals. But despite this, not only the auditors, but also many of his "colleagues" are dissatisfied with the work of the VTsKP. For example, the former head of State Unitary Enterprise "TEK SPb" Arthur Trinoga said that the center's calculations are absolutely not transparent, and offered to conclude direct contracts with consumers. I. Fedorov, who replaced A. Trinoga in July 2014, supported this idea. Earlier, RBC Petersburg wrote that heat debts have been the main subject of dispute between heat suppliers, management companies and the city for several years now. As representatives of heat supply companies have repeatedly said, the main part of overdue receivables hangs on utility service providers. About 80% of them are housing organizations with state participation, that is, subordinate to the Housing Committee. They get the money of consumers, which transfers the VTsKP. At the same time, as previously specified in TEK SPb, the VTsKP transfers money in a single stream, without specifying the payment period. And this complicates the work of determining and collecting debts from utility service providers.
Denis Fedorov, head of Gazprom Energoholding (owner of a 51.79% stake in TGC-1), even called VTsKP a "black box" last summer. “We don’t understand at all what standards he bills. At the same time, Valery Vogachev, Deputy Chairman of the Housing Committee, defended the VTsKP more than once, stating that the center only prints and sends out receipts to residents based on the data provided to it by management companies. According to him, the VTsKP always transfers money in full. As Vasily Fedotov, the head of the All-Russian Central Committee of the Communist Party, explained earlier in an interview with RBC Petersburg, the nature of the debts of managing organizations to resource supply organizations (RSOs) has several reasons. The so-called "balance" method used in the calculation of MA and RSO before 2012 had serious errors and a priori led to debts. But this freedom also has the opposite effect: it lies in the fact that since there is such an opportunity, then we will inevitably have people who want to vote in their own way and choose the management company that, in their opinion, is more suitable for this. This is easy to manipulate. And if an active, but roguish head of the Criminal Code appears, he can easily attract supporters... Such issues are within the competence of the prosecutor's office, courts and district administrations. And they are engaged in them, but not always quickly and successfully. One such example is the well-known house at 19 Varshavskaya Street. For many years, resource-supplying organizations have been trying to get the money due to them from public utilities or residents. At some stage, it turns out: the chairman of the HOA lives abroad, pays nothing to anyone, and all the payments collected from the tenants fall into unknown accounts. So the legally justified freedom of choice gives rise to the possibility of abuse of this freedom. As soon as we get the opportunity to buy property that is part of an apartment building and take part in managing it by voting, we immediately create the ground for future conflicts. But it also increases our responsibility for our property.
- What is your advice to people who received double receipts - which one should they still pay for? Or wait until law enforcement agencies sort out the conflict?
“Of course you can’t pay. But while the proceedings are going on, it is necessary to fix the existing problem legally. To do this, you must apply to the control authorities - to the housing inspection, to the local administration or to law enforcement agencies, indicating that you received two receipts for payment of housing and communal services at once. It is also worth noting which of them you consider it necessary to pay. A person who conscientiously fulfills his duties will prove his case in any case. The one who wanted to take advantage of the murky situation and did not pay anything at all, only drives the problem deeper. Moreover, those who, for some reason, do not pay utility bills, are a debtor and lose the right to receive budget subsidies and benefits.
- And if one of the receipts shows a strange bank account, will this money be lost?
- Of course, the law does not provide that any chairman of the HOA can indicate his personal account and transfer payments to it. Although there are cases when accounts of a personal company are indicated. For example, now the conflict is going on in the management company "Direct Investments", serving a number of houses in the Admiralteisky district. By the way, our wonderful people's artist Oleg Basilashvili lives in one of the houses serviced, unfortunately, by this company. As far as I know, the founders of "Direct Investments" issued a statement that they had a raider takeover and some individuals are acting on behalf of this company. Who is right and who is wrong will be investigated by law enforcement agencies. Unfortunately, this difficult transitional phase will have to be endured. In my opinion, it is safer to pay for the pink receipt of the VTsKP. We, as a state unitary enterprise, split payments and transfer the necessary amounts to resource-supplying organizations. But housing payments, while there is a conflict, we accumulate. And they won't get lost. We argue like this: yes, you have a conflict, you have changed accounts. We are not an arbitrator, we are not a court and we do not decide which of you is good and which is bad. When all proceedings are completed, the legitimate recipient will receive all the money paid by citizens.
- Vasily Nikolaevich, are there any statistics: how many debtors for utility bills do we have in the city?
- According to long-term statistics, about 2 - 5% of citizens in St. Petersburg do not pay for utilities. Over the past three years, the number of debtors has decreased to 3%. It would seem a little. But if we calculate this amount for the houses located in our service area, we get 1.5 billion rubles in one year. And this is already a big amount.
- What is your forecast in connection with the economic crisis: will the percentage of debtors continue to grow?
- I hope no. On the one hand, of course, we can talk about a crisis and crisis phenomena in our economy. But with regard to utility tariffs, they do not grow like that against the background of a doubling of the value of the currency. And compared, for example, with food prices, housing and communal services tariffs do not gallop, since they are established and normalized for a long period. At the same time, if you look at the amounts that St. Petersburg residents pay today for heating, they are even declining. Our calculations showed that as soon as we switched to payment for heat by residents according to meter readings, from the heating season 2012/13, annual savings in heat payment amounted to about 9% compared to charges according to the standard. If in numbers, then, for example, in the last heating season, instead of 16 billion rubles, which could be charged according to the norms for heat, St. Petersburg residents as a whole were billed for only 14.7 billion rubles. At the same time, there are houses in the city where savings on heating bills amounted to 30-40% during the heating period. However, in the case of long-term crisis processes, of course, there are risks of a decrease in payment discipline.
