If the length of service of the military was more than 10, but less than 20 years, then the used funded funds remain with the military, however, the remaining part of the loan is paid by the NIS participant independently.
If a military man with more than 10 years of service is dismissed on preferential terms, then he does not have financial obligations before the bank - the state will pay off the mortgage. "Good" grounds for dismissal may include downsizing, health problems, or reaching the age limit of 45 years.
In case of dismissal with a length of service of more than 20 years, the funds of the CZhZ are non-refundable. Rights of a participant in the savings and mortgage system

The solution to the problem was the development of a conceptually new, financial form housing for military personnel. On August 20, 2004, President of the Russian Federation Vladimir Putin signed federal law No. 117 “On the savings and mortgage system”.
117 FZ entered into force on January 1, 2005 and allowed employees to purchase real estate at the expense of the Ministry of Defense, by attracting a targeted housing loan "CZHZ". Additionally, it was possible to use a preferential state loan under the Military Mortgage program, the maximum amount of which was much more than that of civil mortgage counterparts.
Briefly about the principle of the system
The functionality of the accumulative mortgage system, in its simplest form, is the transfer of finances to a military man. From the moment of joining the NIS, a fixed amount is annually transferred to the participant’s personal account sum of money- "contributory contribution".

Benefits of a military mortgage
Comparing the financial (NIS) and in-kind form of housing for military personnel, we can highlight the main advantages of the first:

- Possibility of choice. Participants get access to the primary and secondary real estate market, up to the purchase of a townhouse or house along with land plot. There are no regional restrictions, an apartment can be bought without being "linked" to the place of service.
- Saving. Military personnel attract no more than 10% of their own savings when buying a home. In addition, they have the opportunity to purchase several apartments at the same time.
- Reusability. The law provides for the possibility of reusing a military mortgage in the event of early repayment loan.Unification. Married members of the system have the right to combine savings, thereby increasing the value of a potential apartment.
Separately, it is worth highlighting the maternity capital. Families with 2 or more children can use the mat. capital for the down payment or early payment military mortgage. Such an opportunity was originally laid down in 117 Federal Laws, but until recently it remained inaccessible.
Only since 2017, some partner banks of FGKU "Rosvoenipoteki" began to practice the use of maternity capital funds (pr. Bank ZENIT).
Who is eligible to join the NIS
- Military personnel who signed a contract or graduated from a military school and received their first officer rank before January 1, 2005. In this case, it is possible to become a participant on a voluntary basis by writing a report. If the contract was signed after the entry into force of 117 FZ, then the military without fail are entered in the register of NIS participants, with the right to use military mortgage.
- Military personnel with the rank of warrant officer, midshipman or foreman, who entered the service from the ranks of the reserve and have served since 2005 for at least 3 years.
- Soldiers, foremen, sergeants or sailors who, after 2005, signed another contract and expressed a voluntary desire to join the state system.
However, individuals who have not used a military mortgage and are registered on a voluntary basis may refuse to participate. The procedure requires filing statement of claim to the garrison court.
Registration mechanism
To be included in the register of the accumulative mortgage system, a serviceman must draw up a report addressed to the unit commander. The application is sent to the person responsible for the NIS, who, in turn, is obliged to compile lists of potential participants and submit parts for consideration by the management.
The last step is the opening of a personal account of the participant by the Federal State Institution "Rosvoenipoteka", which oversees the work state system and the program "Military Mortgage".
It should be noted that the registration procedure should not exceed the statutory period of 3 months, after which the serviceman is obliged to obtain a certificate of the NIS participant.
From the moment the certificate is received, FGKU "Rosvoinipoteka" transfers to the participant's account a monthly funded contribution, for 2018 amounting to 22,372.1 rubles. At the same time, the right to use a military mortgage and a targeted housing loan (CHL) comes after 3 years of participation in the NIS.
Obtaining a CZHZ certificate
As already mentioned, after three years of participation in the accumulative mortgage system, a serviceman gets the opportunity to use budget funds to buy an apartment.
To do this, you need to submit a report addressed to the commander of the unit on obtaining the right to use a targeted housing loan. The application must indicate the need for improvement of living conditions.

Further, the papers are drawn up and brought to the participant of the FGKU "Rosvoenipotekoy". The certificate contains information on the available amount of the CHL and parameters for calculating the military mortgage: the amount of savings, the amount monthly payments, loan term. By law, the entire procedure should take no more than 1 month from the date of submission of the report.
The certificate is valid for six months. The serviceman will receive it 30 days after signing, so there is only 5 months left to apply to the bank, get a mortgage and find housing. The document will have to be requested again if it expires.
Choosing a bank and real estate market
After receiving the necessary papers from Rosvoenipoteka, the serviceman can proceed to the choice of housing. It is worth starting with the real estate market:
- Primary. Provides an opportunity to invest in the construction of a house, after the conclusion of the contract equity participation. Once the type of market has been chosen, the offers of realtors should be considered in detail and construction companies. By law, a soldier has the right to acquire:
- housing in an apartment building;
- a cottage that meets the established standards of residence;
- townhouse or private house with land;
- communal apartment.

Collection of documents for submission to the bank
When applying for a military mortgage on your own, a soldier must have the following documents with him:

- an identity document (passport of the spouse or spouse is not required);

After submitting the documents, the bank conducts a verification procedure and then makes a decision regarding the serviceman. If the participant meets the requirements and the papers are in order, he is recognized as a military mortgage borrower, and a special bank account is opened in his name.
This account is for Purpose-Based Housing Loan funds only - there is no possibility to withdraw cash.
Also, the soldier will be required to provide information about market value purchased property. The document is compiled by an appraisal company that has permission and the necessary licenses for this type of activity. The list of appraisers can be obtained from the employees of the bank in which the military mortgage was issued.
Documents for Rosreestr
The final step in buying a home on a military mortgage is the provision of documents in Federal Service state registration. The main papers required by Rosreestr include:
- contract for the sale of real estate;
- mortgage;
- target housing loan agreement;
- identity document;
- an agreement on the allocation of a military mortgage by a bank;
- notarized consent of the spouse for the purchase of housing;
- marriage contract (if any) and marriage certificate;
- passport of the owner or seller of housing;
- notarized consent of the spouse of the seller;
- an agreement between the guardianship authorities for the sale of housing (in rare cases, if the property is owned by children under 18 years of age or citizens with disabilities);
- application of a serviceman for registration of the right;
- application from the owner of real estate for registration of the transfer of rights.
In some cases, Rosreestr may require additional information. To clarify the full list of documents, you should contact the department of the institution at the place of the transaction.
A warning!
After registering the right of ownership, the serviceman needs to receive an extract from the USRN, where information will be noted about the presence of a double encumbrance (bank and state) in housing. An extract is provided to the bank, and the lender transfers the CHL and military mortgage funds to the account of the real estate seller.
The final step is to send an extract from the USRN to FGKU Rosvoenipoteka. Attached to it is a document confirming payment under the contract and a schedule of monthly payments. The actual amount available for the purchase of housing on a military mortgage consists of several items: the funded part, annually credited to the account of a participant in the savings and mortgage system; military mortgage provided by the bank; the soldier's own money.
In order to use the funds accumulated in the account, it is necessary to issue a certificate of eligibility for a targeted housing loan. This can be done already three years after the inclusion of a serviceman in the NIS program.
However, quite a few savings will accumulate in the military's mortgage account over this period. For example, the amount of the funded contribution in 2016, as well as last year, is 245.88 thousand rubles.
The maximum loan amount provided by the bank under the program is 2.3 million rubles. Although in most cases, according to the interlocutors of the agency, the bank does approve a smaller amount.

First, you have to pay for the services of a realtor. It is difficult and dangerous to engage in the selection of real estate on your own - you need a lot of free time, and every day scammers come up with more and more schemes to deceive ignorant citizens.
Secondly, you will have to pay for various related services: real estate appraisal and paperwork (for example, sales contracts and targeted housing loans).
“About 112 thousand was spent purely on registration, that is, only on documents. Although initially they planned to simply add this money to the cost of the apartment,” a military member of the NIS told Mil.Estate earlier.
Rosvoinipotek explained to the agency that all the above contracts can be filled out absolutely free of charge on your own. “The CZHZ agreement is filled out independently. It is downloaded from the Rosvoenipoteka website and no money has to be paid for it,” the structure stressed.

Rosvoinipotek explained that insurance payments are a duty of a citizen, in no way connected with NIS. “This is a mortgage law requirement. The amount of savings does not depend on the size of the family. Another feature of the program is that the amount of NIS savings does not depend on the number of family members of a serviceman. For a large family with 2-3 children, this can be a problem. Paperwork at the bank may take more than one month. Despite the fact that the program has been worked out and is widely implemented throughout the Russian Federation, the execution of documents at the bank can take several months. The total duration of coordination and execution of all necessary documents in the bank can reach 2 - 4 months.
Indexation of annual accruals to a NIS participant
Let's return to the annual accruals to the account of the NIS participant, which are used to pay off the mortgage. According to the military, the bank initially provides for an increase in annual payments.
But whether the indexation of the annual accrual to the account of the NIS participant will correspond to an increase in the amount of payments, no one knows for sure, which means that a situation is quite possible when the military will have to pay off the difference at his own expense. It is also doubtful that the funded contribution was not indexed in 2016, although in 2008-2015 the amount was indexed annually.
Rosvoenipotek emphasized that such a situation could not arise. Payments are made in accordance with the schedule approved when applying for a loan.
“The amount paid by the state is annually approved by the Federal Budget Law. The state pays 1/12 of this amount monthly. The bank calculates the payment on the basis of the amount set in the budget,” the interlocutor specified.
The apartment is easy to lose
Perhaps the most important risk when buying housing under the military mortgage program is the fact that a military man can easily lose his apartment upon early dismissal from service, even if this dismissal occurred for reasons beyond his control (for example, in connection with the disbandment of the unit).
Upon dismissal with less than 10 years of service, the NIS participant must return all the funds previously allocated to him for the purchase of housing by the CHL from his own pocket, and repay the remaining loan on his own.

The presence of preferential grounds in this case will not play any role. Moreover, the money must be returned no later than 10 years from the date of dismissal, taking into account interest equal to the refinancing rate.
Otherwise, both the bank and Rosvoenipoteka will demand money in court, and if the military cannot repay the debt, they will take away the housing that is in double pledge. If a serviceman contributed his own funds when buying an apartment, no one will return them in case of early termination of the contract.
If the length of service of the military was more than 10, but less than 20 years, then the used funded funds remain with the military, however, the remaining part of the loan is paid by the NIS participant independently.
If a military man with more than 10 years of service is dismissed on preferential terms, then he has no financial obligations to the bank - the state will pay off the mortgage. “Good” grounds for dismissal can be a reduction in the military unit, health problems, or reaching the age limit of 45 years.
In case of dismissal with a length of service of more than 20 years, the funds of the CZhZ are non-refundable. True, there is one nuance here, which one of the interlocutors of the agency drew attention to: if at the time of registration of a military mortgage, a soldier had only 10 years to retire (before reaching a length of service of 20 years), and the mortgage is designed for 12 years, then in order for payments from the budget was fully covered by the mortgage, another two years the military will need to serve over the term.
If a military man with a length of service of 20 years has not used the funds of the NIS, he receives the right to use nominal savings at his own discretion.
Additional documents from the spouse
In the case of adding own funds from the wife of a military member, NIS may require additional documents, namely a notarized statement stating that the money paid by the military family is not jointly acquired property.
